  • Yes, you can claim unpaid item charges for returning cheques and unauthorised borrowing if they have charged you for that.

    I thought the business claims had ended, as they lost in the test case, and the OFT decided not to appeal?

    hi

    business accounts are not covered by the UTCCR and the test case decided that charges are not unfair penalties for banks "current" T&C. If the test case decides Historic T&C are penaalties a claim will be possible.

    all the above assumes T&C are/were similar for business accounts and person current accounts

    I dont know if the FOS are still taking complaints regarding business accounts,if they are the waiver should not apply as business accounts are not part of the test case.

  • My partner had a business account with Nat west. We have written to them to claim bank the unfair charges. They have written back and offered £880 in full and final settlement. The total claimed is around £7,000. Any thoughts on whether to accept the offer or push it further?

    There is no point in negative thought, it takes up time and energy which could be used in a positive, happy way!
  • :mad: I have a business bank account with Lloyds TSB because my boyfriend and I are joint partners in a pub. I have completed the Bank Charges Reclaiming forms and sent them off. The reply from them states that businesses are not covered by the rulings. We've been charged £35 for every returned cheque/direct debit and their costs are the same as a personal account (simple letter of advice to us) so why can't we reclaim, please?

  • can someone tel me if I am entitled to claim business banking charges that ended up crippling my business? The charges being for overdraft and also a cash handling charge to deposit cash in the bank.

    yes you can have a read of the other threads on here and then post any questions you may have

    please remember that buisness claims are not covered but the test case and can still go ahead but I believe (may be wrong) that the wording is different as you wouldn't be claiming using UTTCR
