    claimed/settled - Natwest £2,535/£2,535, HSBC visa £80/£80, MBNA £1,258/£1,258, capital one £282/£282, tesco visa £515/£515, HSBC visa £140/£140. HSBC £1,450 MCOL Stayed for OFT case. Chelsea Mortgage charges & cashback £5000/£672. complaints with banks pending OFT Halifax £30, A&L £35. TOTALS £11,325/£5482
  • I put in a complaint re bank charges to my previous bank last year. It was a business account. Today i've got a letter rejecting the complaint and they said the bank is entitled at all times to collect its fees as outlined in the price list and do not breach any terms of the account and therefore do not constitute common law penalties. Furthermore the provisions of the Unfair terms in Consumer Contracts Regulations 1999 do not apply to business customers.

    Is there anything else i can do? Or can i go no further with this complaint for unfair bank charges?

    Send it onto the Ombudsmen, I had the same response from Lloyds for our business charges, they took it up with them, and we are now awaiting a cheque for £1,530. Business accounts are covered by Common Law not Consumer Law, but the bank wont tell you that !

  • Thanks for your response. Is that the amount you claimed for?

    The total of my claim is over £7000 but i don't expect to get that.

    no We only claimed for £ 900 in charges with interest added total claim was
    £ 1,200, but they paid us £ 1,530.

  • hey people, i have recently closed my bussiness as i could not keep up with the charges the banks were charging me for going over my limit as customers didn't pay me on time so the bank wacked on lots of charges the escelate, what the deal with bussiness bank accounts, my lloyds tsb manager said that they were different and that dont act the same??

    is his true and can i claim?

    at a guess it will be £1,000's

    You cannot claim under consumer legislation (e.g. Unfair Terms in Consumer Contracts Regs) but the principles of penalties being unenforceable still apply.

    The question has been asked many times so if you do a search there should be a stack of info.

    id just add that business claims are not on hold so your claim should not be delayed.
