They will argue this is a fee for a service (providing you with an overdraft facility) I haven't heard of anyone who's got this back before under reclaiming - sometimes banks have reduced/refunded as a gesture of goodwill but it doesn't come under reclaimable fees.Gwlad heb iaith, gwlad heb galon0

Seems a degree of uncertainty on this matter. From the sounds of it, you cant claim under consumer law but could under unfair penalties regulation...Total Reclaimed from banks and credit cards so far: £14139 :T

My husband is trying to claim back charges on a business account and he has had a reply from the HSBC who state that the court has confirmed that in respect of HSBC, charges are not capable of amounting to penalties at common law. WHAT DOES THIS MEAN??? Then it goes on to state in the letter, "we believe that finding would apply equally to our business banking terms and conditions and that if your request proceeded to court we would successfully resist any legal challenge brought against us in relation to these fees." They then go on to say they are not prepared to refund the charges we requested and if we remain unsatisfied go the ombudsman. HOW SHOULD WE PROCEED????0

I have a Barclays account, I am a sole trader and the charges on the account over the last few years are probably in the region of £6K - £10K
How do I reclaim? Are there any template letters or do I just use the ones in the main article?

I claimed from 2 business accounts with the natwest, one which was still open and one which had been closed for 5 years using those letters. i did read afterwards that they didn't apply to business accounts, but I got most of the money back anyway, far more than I expected, sorry I can't be of more helpand good luck.Debt Free Dec 2009non-smoker 19th Nov 2010Trying to lose weight 40lb/42lb

Very straight forward, I did the open account first sent a letter and within a couple of weeks had a letter back saying they didn't agree with me but as a good will gesture were going to offer £2652.00 it was about three quarters of what I had claimed,but it was money I never thought I'd see again, i accepted immediately. Once I had received that I claimed on by husbands closed bank account, there was only about a years worth, got back £240.00. I am wondering if anyone has attempted to reclaim charges on a business bank account? Is is even possible, or do business accounts not qualify?
I also wrote to HSBC to claim back business bank overdraft charges but have been told that these charges are in the terms and conditions. Also they are stating that the Court have confirmed that their unauthorised overdraft charges, personal current accounts as opposed to business accounts, are not capable of amounting to penalties at common law.
I am now going back to my bank manager who is aware of financial hardship suffered during the time my husband was in hospital and convalescing after being diagnosed with prostrate cancer. He has now recovered and back at work but during the year he was not in work, the bank continued to charge overdraft charges which I am now trying to recover.
Any advice from anyone who has been in a similar situation would be appreciated.0
