Can anyone tell me if it is possible to reclaim bank charges from a business account in the same way as a private account?0

Yes you can for similar charges that you would claim from a personal account but not the "business" type charges such as charges for paying in cash or monthly/annual service charge fees.0

Two weeks ago I sent a letter to the Bank of Scotland asking for a refund of charges, over 5 years, applied (taken from) my small ( as in I am the only employee) Ltd Company account for exceeding the company overdraft limit. The bank has replied stating that 'the unfair Terms in Consumer Contracts Regulations do not apply to business customers' and then Bank further stated that 'they are not willing to refund the charges levied as they were applied in keeping with our terms and conditions, which you will have agreed to'.
Is this true?

Of course they can be claimed still.. They may not be subject to that particular statute but they are still claimable..Halifax ~ Done and dusted

They are the business in this case and you are the consumer. I fail to comprehend why they dont class you as a consumer using their services. I call shenanigans and advise you to carry on claiming. Dont worry about arguing the point with them just carry on regardless0 -
That statute does not apply and you should not include it in your particulars of claim when you file in court.
People have been struck out on that basis alone.
