    If you are reacting on the phone as you have been on this thread, then I imagine that you have got yourself and the person on the phone confused. What the letter says is what you have been told numerous times on here, that the student is exempt and you are not.

    I asked over the phone

    "how come there is a charge to our council tax"

    she looked on computer and told me that

    "you have received CTB however your flat mate still needs to pay 75%"

    i then questioned

    "But my flat mates is a full time student"

    to which she replied

    "because you are on benefits then your flat mate is not entitled to being excused from CT as a student"

    Simple answer is that ,for one one reason or another, they gave you the wrong information.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    If the student is a full-time student then they should not be liable for Council Tax and therefore their name should not appear on the bill.

    In this case, you are the only liable person in the property and so the council tax liability should be in your name only.
    The problem in this case is determining if the student is just named as an occupier or as the liable party.

    If they are joint tenants then the student is not jointly liable but if the student has the higher interest in the propery then they would have to remain liable.

    I think that the students name is on the bill because she was in this flat the previous year and is registered on the electoral roll, so her name is automatically added to the letter.

    The problems is that i should only be charged water and wastage charge and have the council tax paid due to benefits, i have put a claim in and been told it has been sorted out, even receiving a letter to confirm it, however thinking about it, i dont think they have back tracked it when i actually moved in, thats why the payments dont add up.

    Im going to go into the office in person and speak to someone face to face with all needed information, i might have more chance in getting somewhere rather than speaking on the phone.
