I, KEITH WEBSTER, AM ON INCOME SUPPORT
I HAVE CLAIMED FOR AND BEEN AWARDED CTB
I HAVE BEEN TOLD THAT DUE TO ME CLAIMING CTB MY STUDENT FLAT MATE HAS TO PAY 75% CT

MY FLAT MATE IS A STUDENT, SHE HAS BEEN TOLD THAT SHE IS EXEMPT FROM COUNCIL TAX
THEY SAID THAT ME, KEITH WEBSTER, HAS TO PAY 75% CT.

WHICH ONE IS TRUE IF EITHER

DOES ANYONE KNOW IF EITHER OF THESE ARE TRUE?
WITH MY CTB AND THE OTHER FLAT MATE BEING A STUDENT, DOES THAT MEAN THAT NO CT SHOULD BE CHARGED FOR US TO PAY?

Where that are two occupiers in the property who are joint tenants and one of those occs is a F/T student then the student is disregarded from Council Tax and the remaining 75% charge falls on the person who is not a student.

When two people share a property then ordinarily the Council Tax is apportioned so that each person can receive CTB only up to a maximum of 50% however where the person claiming CTB is on IS and the other occ is a F/T student then the claimant with have the full 75% CTB paid.
I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

Honestly, I think you are hindering rather than helping and are causing more confusion. Let your friend sort it out.

keet i have explained what is happening to you .. the email explains what is happening .. you have to pay 75% of council tax your friend student is exempt
you have applied for coucil tax benefit 10.43 week you have been awarded 10.43 * 48 ( one month usually march no council tax paid) = 500.64 this more then enough covers your 75% share ...
so you have nothing to worry about

Thank you for that, so neither of us should have to make a payment for council tax.

i will have a word with the council tax office about it then and try and sort it out.

  • I am a student and I am excempt from paying council tax.

Mr Always is soley responsible for paying the bill and he gets 25% single person's discount.

If you do not apply for CTB, despite being on IS, you are responsible for paying the CT bill.

When you apply for CTB you still get a CT bill but once your CTB is sorted out it will be a bill for zero.

i have been awarded CTB, thats why its confusing. why is the student being charged council tax?

They aren't! The letter you quoted earlier says quite clearly that the student is exempt and that you, Mr Webster, have received the single person discount.

"As there are two tenants in the property and you are the only student you have been disregarded for Council Tax purposes.

    Mr Webster
has been awarded 25% discount and is liable for the Council Tax charge of £496.32"

I imagine that your CTB benefit hasn't been applied at this point.

If you are reacting on the phone as you have been on this thread, then I imagine that you have got yourself and the person on the phone confused. What the letter says is what you have been told numerous times on here, that the student is exempt and you are not.
