    Correct, however, the Railway companies ain't daft and have a fail safe means to get you, they will cancel the penalty fare or unpaid fare notice and issue a summons under;

    i) the strict liability offence of 'Fail to show a valid ticket' contrary to National Railway Byelaw 18.1 (2005)

    or

    ii) 'intent to avoid a rail fare' contrary to Section 5.3.a of The Regulation of Railways Act (1889)

    Which both are a criminal offence and are dealt with in a magistrates court.

    Its too good a cash cow for the railway's to give up and as you rightly stated most people are intimidated into paying out rightly or wrongly.

    Yes but I am only saying that PFN are not enforceable, at some point their use to force people to pay will be challenged, because most people would give up when they realise that a court is the next step. I would say to go to court if you have a cast iron defence which by the way the OP does not have.

    The whole argument above is about whether a child should be relied upon to give a slip of paper to their parents, the parents should be involved straight from the off, and given a chance to make amends before the rail company increase their profits by their cash cow!
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    They are not enforceable unless the company sues and takes you to court, and the person presiding agrees that it so.

    Problem is as I stated they cancel the Penalty fare or Unpaid fare Notice and prosecute under bye laws to which you normally have no defence. If you do have a defence, the train companies drop the case like a lead balloon as they don't want to set a precedent in court, which would open the flood gates to counter claims, they the 'train company' are very much in control I'm sorry to say.

    Having read the whole thread, IMHO I think my 14 year son would have done the same and tried to have hidden it from me. I think the train companies should follow up with offences involving minors, ie a letter sent to the home address, not that this helps the OP much :o
