I'm going to lose this one aren't I?

I'm a little perturbed (never had a problem like this on ebay before). A buyer is saying that the item I sold isn't as described while I maintain it is.

The messages are as below:

Buyer : hi your description of the top is a mens vest.,. your title says vest and t shirt this is done usually so it shows up in more searches , but your description cleary states its a vest and it isnt , to return it it will cost more than its worth,. i will await your response,.

Me : Hi,

I'm sorry this isn't what you thought it was.

However, you will see from the label that it's official description is VEST, MAN's, PT, OLIVE. I did put 'T Shirt' in the title and described it as a 'shirt' in my narrative to try to avoid misunderstanding.

These are actually often worn as vests under the CS'95 Combat Shirt.

I'd be quite happy for you to return this item in the condition you received it, but as you say it's not worth it what exactly are you asking for?

Yours,

Buyer : it was described in the description as a vest, i will return it no problem , but will expect a full refund including postage both ways as your description does say its a vest which it isnt,. regards steve, please send me the return adress and confirm you will give me a full refund, .

Me : Hi,

I am happy for you to return it in the original condition and am also happy to refund the purchase price only.

The item was not misrepresented as I have already explained.

Yours,

Buyer : your personal description clearly states its a vest! no mention at all of it being a t shirt, FACT! so why the hell should i pay for postage twice on something which is clearly not as described, read your description then re think this or i will simply report this to ebay and leave you a neg! not the way i would like this to end up but you leave me no choice.

Me : Hi,

If you feel you have to report it, then there is no way I can prevent this. However, my description was perfectly honest. If you look, you will see that I describe it as a shirt in two places

"Here we have a Vest Man's PT in Olive Green as issued to serving British Soldiers.

The shirt is Army Olive Green in colour and is generally worn as an extra layer under the CS'95 Shirt or Field Jacket.

This shirt is BRAND NEW and UNWORN.

Size : 118cm

NSN : 8415-99-978-9979

If you care to take a look at my feedback, you will see that I am an honest seller. I have not misrepresented the item and can only repeat my offer to refund your purchase price upon return in original condition.

Yours,

Buyer : sorry im not paying £5 postage approx(either way) to recieve a couple of pounds, do the maths! i have been ripped off , end of issue you wont resolve it so i will revert to what i said, DO NOT CONTACT ME ANYMORE! enjoy your feedback,

He's now left negative feedback of : NOT AS DESCRIBED!!! WILL NOT REFUND!!! BEWARE TOTAL LIAR!!! BAD EBAYER!!!!!!!!

To which I've replied : Innaccurate feedback. Seller didn't understand description. Refund offered.

I'm probably on a hiding to nothing with this (as he's now opened a claim on ebay), but it annoys me that it's going to cost me because he didn't read the listing properly.

Or am I being unreasonable?

A vest implies a sleeveless article, a t shirt shirt, short sleeves, which is it?
  • It's an Olive Green Army T Shirt - but the official label on the packaging describes it as a vest (if you look up the NSN, it says vest too). However, I did call it a Tshirt on the title of the item (as the buyer admits).

I can understand where the buyer has got confused and why they would be annoyed by this. Was there a picture with the listing? A vest and a shirt are very different. If I had been listing it I would have clearly spelled out that although the top is described as a vest it is more like a shirt in its design as it had sleeves (or whatever it is that means the buyer doesnt see it as a vest!).

I think the buyer is being a little narky in the comments but when your first reply was 'what exactly are you asking for' Im not surprised! It would have been much better to simply reply that you didnt feel it was misrepresented however as a gesture of goodwill you would honour a refund upon return.

Vests have sleeves sometimes and sometimes not.

Tell him to bog off and ignore him.

It said 'vest t shirt' in the title of the listing, so he should have asked for more info if he didn't know what he was buying.

It says vest on the packaging too, you're quite right.

Wear the neg with pride ;)

    Or am I being unreasonable?

    In some ways yes.

The buyer is a bit of a Muppet. But you really haven't helped yourself. In any refund the buyer is entitled to his full original payment back including postage. you cant keep the original postage back just so you make some profit. So by saying that you showed you had little understanding of the buyers rights so that is bound to wind anyone up.

    Looking at your listing

    http://cgi.ebay.co.uk/ws/eBayISAPI.dll?ViewItem&item=290457700500

The picture doesn't actually show anything and you really don't make it obvious that it's a T shirt.

Also take this out of your listings
I ALWAYS obtain proof of posting and will happily make this available should there be a postage problem. I cannot take responsibility for items lost in the mail.

Because you are responsible and it makes you look a bit clueless. A buyer doesn't care if you get proof of posting or not they have enough protection in Paypal. If an item goes missing and you refuse to refund them or even sillier send them the proof of posting all they need to do is open a Paypal claim to get refunded.

The buyer may have been a bit of an idiot but i'm on his side. Your poor description and listing and bad handling of the situation got you that neg

    totally agree with cyberbob..

unfortuantely, your picture shows nothing... just a something wrapped in cellophane!

you really would have been better opening the packaging and taking photos to show what the item was!

    >Or am I being unreasonable?<

Yes. After reading this and the listing, I still don't know what the item actually is. If you'd spent the time taking a picture instead of all the blather in the listing you'd have avoided the neg.

    > I did put 'T Shirt' in the title and described it as a 'shirt' in my narrative to try to avoid misunderstanding.<

    LOL, it's a vest or a t-shirt or a shirt...buyer is understandably aggrieved.
