  • I had to issue legal proceedings to receive some/all of my cashback
    Nearly anyone can win a case against P2U.

    If you do something wrong as they claim in nearly every situation they do not give you the ooportunity to correct the error. District Judge Christopher Lethem ruled in Tunbridge Wells County Court that part of Phones 2U Direct's Terms And Conditions are in breach of The Unfair Terms In Consumer Contracts Regulations 1999 They do not give you the opportnuity to rectify any y error you make. Not answering emails telephone calls etc etc is UNFAIR


    Has NE one ever spoken to the Customer service guy who signs all the letters Alan Bowen, then again has anyone ever spoken to Father Christmas. Put him on any court documents and ask for him to appear in court I bet he cant.

    Ofcom has launched a new code of practice for mobile retailers designed to curb 'slamming' and dodgy cashback offers, hoping the move will see off the need for new laws.

    Slamming, the widespread practice of a reseller misrepresenting itself as an operator, is being targeted, as is the business of offerin cashbacks that are hard to recover.

    The new sales code is being backed by all five networks. Among a host of rules, Ofcom states: 'The expression “calling on behalf of [network]” should not be used.'


    Cashback offers should no longer need original statements as proofs and must allow a minimum 60-day redemption period.

    Ofcom chief Ed Richards (pictured) said: 'We expect this new voluntary code of practice to stamp out mis-selling in mobile; if it does not, we will not hesitate to step in to protect consumers.'

    Ofcom said there was 'growing evidence' that those selling mobile services were confusing or misleading consumers.

    Ofcom is currently receiving in the region of 400 complaints per month about cashback promotion schemes which do not reimburse customers and cold calling.

    The code of practice sets out minimum business standards, including prohibited sales and marketing practices; how retailers must comply, including details of proactive monitoring by MNOs and possible sanctions; due-diligence exercises to determine which retailers should be engaged; and how complaints to MNOs should be monitored and handled

    Completed my court claim earlier this week for no 1 claim as p2u have not paid , they have 14 days to respond , 9th bill arrived this morning for my 2nd cashback claim , on the bright side when I have to cliam for the 2nd cashback at least I will be familiar with the process , for this second claim I only intend to wait the allocated 45 days then send off 14 day letter before action , giving them a couple of days then file another claim if they dont pay , I would advise all others owed money by P2U to do the same , as they obviously have no intention of paying the majority of valid claims unless the legal road is followed !!! I will post later on furthert developments :mad:

    Issued claim and received notification this morning that Mr Bunce is disputing part of my claim and now has 28 days to defend? HOW CAN THEY DEFEND PART????? Surely it is all or nothing? - or simply delay tactics. I also received my 9th month bill this morning - My mum has a theory that they keep you tied up on the first claim hoping that you miss the 2nd and therefore default on the 3rd! Bring it on I say - I am just in the mood for a fight! My concern is that these people are starting to delay claims until the heat gets too much and they go bankrupt owing the maximum amount possible.(only to start gain as phonys2udirect next week):mad:
  • Don't use Royal Mail Recorded Delivery. I did and when I tried to use the trace service, they said that they didn't have a signature. They said that they delivered a lot of RD letters to this company and only obtained one signature for the lot (or possibly no signature at all).

    P2U recommend RD but must be aware that they do not usually have to sign, and so they can claim to have not received the claim, which is exactly what happened in my case.

    I am suing them through the Small Claims Court. It cost me £30 and P2U have another week in which to file a defence which they have indicated that they intend doing.

    I would advise using Royal Mail Special Delivery and make sure that you take out the consequential loss cover so that if it doesn't get delivered you should still be able to claim from Royal Mail.

    would like to know the outcome of your case as I think I am in a simillar situation when checked on the internet regarding my letter. Recorded delivery slip had no signature. Although they have never bothered to reply to my several e mails and letter and never mentioned about not getting my papers.

    I have filed claim through money claim online and I am sure they will not defend the case and may use this as an excuse of not getting the papers when case goes in front of the judge. any coments will be appreciated
