  • I had to issue legal proceedings to receive some/all of my cashback
    Once the cheque arrives you have to make your decision there and then. Bank the cheque and accept the loss of £30 to get your cashback or reject the cheque and send it back, and then request a court hearing for the whole amount. However be aware that there is no guarantee that the judge would award costs at the end of the day. So it is worth it. As long as the !!!!!!s pay up it is worth it.

    I'm battling against this bunch of con artists like most people.
    I got my first cheque after 4 months, numerous emails and calls and the threat of legal action. When they said that the cheque would be sent ASAP, it only took four weeks.
    I'm still waiting for the second cheque, which has been 'escalated', after three months.
    I've just sent in the final claim with the threat of legal action if any money is still outstanding by the 5th of February 2007.
    Maybe I won't have to do any more but, just in case, does anyone know the real name of the company?
    Companies house has PHONES 2 U DIRECT LTD and PHONES 2 U DIRECT.CO.UK LIMITED both at the same address. I'd hate to take an innocent company to court.

    Surely it is the same company, one is instore sales and one is online sales?
  • These guys are deliberately difficult to deal with. Had to put in a small claim court claim before I got paid my second cashback.

    I don't know why they do it? They lose more credibility in the long term and lose any future customers. :confused:

    I've received all cashbacks due with some (non-legal) pressure applied
    Just recieved my 9 month £120 cashback cheque this morning. Submitted claim 29th September. Cheque arrived +105 days (Well outside the +45 days in their t&c).

    After numerous ignored emails and failed telephone attempts, I sent in notice of intent for Small Claims Court early December. Didn't recieve any reply but managed to speak to the illusive Jamie Bass (Claims dept) who assured me that a cheque had been raised and should be with me shortly. I left it another week and was intending to submit a cliam.

    Out of desperation and wanting to avoid the £30 court fees, I gave them another call - Got a message passed to Jamie Bass, who called me back within 30mins. Said a cheque had been sent out the previous day and was happy to give me the cheque number.

    As if by magic, today the cheque has arrived.

    Now to keep track of my 12 month claim which I submitted 2nd January. They don't make it easy do they.

  • Through no fault of my own I've lost some/all of my cashback
    I've got a similar contract and they havent replied my month 6 cashback either. My problem is that I cant really remember saving a copy of the contract so I cant remember how much they were supposed to pay me - i was on the Orange Panther 45 contract.
    Has anyone got any details for the same contract?

    Phones 2 U Direct did not send me T&C's (although when I called I was advised I would have been sent one and my sim card selotaped to it) This was not the case.

    When I tried to claim my cashback I contacted Carphone Warehouse as they were the only company I had any paperwork from.

    Carphone Warehouse supplied me with an address to send my claim to.

    Received a reply from C W to advise that I should be claiming directly with subsiduary company.

    I managed to locate Phones 2 U Direct through the insurance docs I was sent.

    Called them and they advised that I would have been sent T&C's and they emailed me a copy.

    t&C's stated I only had 14 days from invoice date (inclusive) to claim - as a result of mis information I was about 3 weeks late submitting my claim but sent all info including orig. bill and letter from CP warehouse and advised that I had not got any T&C's with phone.

    They were late in replying (T&C's adv within 28 days) and advised that I 'signed up' to paperless T&C's - I'm pretty sure that I didn't and have no way of proving it.

    They are now refusing to process any subsequent claims (Months 9 + 12) despite the fact I only took phone on basis it was 12 month contract. I am now paying over the odds for an outdated phone.

    Would it be worth attempting small claims in this situation?

    Please help!!!!

    Would never use this company again. Have used other websites such as one stop phone shop with no problems whatsoever! :mad:

    (Version 3.0)


    The following Terms and Conditions detailed in this and the “Returns” section comprise your agreement with Phones2uDirect.co.uk Ltd for supply of goods and services by us. We may change these Terms from time to time without notice to you. However, any changes will only apply to any orders received after the change.

    We aim to ensure that all the terms laid out do comply with the current law, however if any passage is deemed to be unlawful, this will not invalidate the remainder of the contract.
    All offers are subject to availability and are inclusive of VAT and delivery.

    We accept Visa, MasterCard, Delta & Switch, for all contract orders the sum of £2.50 will be pre-authorised on your card as part of the identification process. Where payment is required for an item, this will be taken once your order is ready for dispatch.

    Contract mobile phones are subject to status and a credit check. In some cases, an additional proof of address and or identification may be asked for. The network may require a deposit or decline your application but you will be notified in all cases.

    All contract mobile phones and SIM cards are subject to a minimum 12 month airtime agreement and unless otherwise stated, are subject to a connection charge.

    Many of our offers are tariff dependent, where the purchase price reduces as the monthly tariff increases. A tariff upgrade or downgrade is based upon the commission paid to subsidise the cost of the handset at the time of purchase and is not necessarily linked to the monthly line rental. Therefore should you wish to change your tariff, please contact us first to ensure you do not inadvertently downgrade and become subject to the conditions below.

    Should you decide to downgrade your tariff the following criteria and charges will apply:

    Orange, Vodafone and Three: If in the first 180 days from connection you downgrade your tariff, you will be charged a minimum of £120 + VAT dependant upon tariff chosen at connection and the new tariff selected.

    O2: If in the first 120 days from connection you downgrade your tariff you will be charged a minimum of £120 + VAT dependant upon tariff chosen at connection and the new tariff selected.

    Tmobile: If in the first 12 months from connection you downgrade your tariff, you will be charged a minimum of £120 + VAT dependant upon tariff chosen at connection and the new tariff selected.

    Should you change your tariff during the first period, either up or down, the "first period" starts again from the date of change.

    In the event of your disconnection from any network for whatever reason within 180 days (other than 7/14 day returns), we will charge you the full retail cost of the handset, accessories and promotional items plus administrative and any other associated costs incurred. If you PORT or migrate a number after connection, onto either O2 or Vodafone, or if you transfer a number from the same network onto a phone we have supplied on that network, this will be deemed as a disconnection and subject to the same penalties.

    In the event of either of the above you shall hereby authorise Phones2uDirect.co.uk Ltd to charge the amounts to the credit/debit card details given as proof of id/purchase. In addition, the occurrence of any of the above will nullify any promotion or giveaway that Phones2uDirect.co.uk Ltd offer with the purchase of a handset.

    Whilst we take every care to provide accurate information online, all prices on an order will need to be validated as part of the acceptance procedure. In addition it should be noted that promotions and pricings may change at the beginning of a calendar month. We will inform you if a product’s correct price is higher than stated in your order, or if a promotion is different from that shown online. You will reserve the right to cancel the order and will be offered the choice whether or not to continue with the correct deal as specified. Please note that whilst we attempt to keep all product images on the site as accurate as possible, exact colour can vary between networks and available supply.

    SIM Free handsets are enabled to operate on the majority of European networks, however Phones2uDirect.co.uk Ltd do not guarantee that all features advertised will operate on all networks, as some features (such as GPRS & MMS) are network and service dependent. We regret that if a phone proves to be incompatible with some network features, we cannot treat the item as faulty and it will be subject to the normal terms relating to returns.

    Cashbacks

    Cashback offers can be claimed from month 6 of your contract. Where the amount is less than £50, then this will be paid in one instalment after the receipt of your 6th month’s invoice as per the instructions below.

    On 12 month contracts, cashbacks valued over £50 will be paid in 3 instalments, one third of the cashback at month 6, one third at month 9 and the final third on month 12.

    On 18 month contracts, cashbacks valued over £50 will be paid in 5 instalments, one fifth of the cashback at month 6 and the subsequent fifths at months 9, 12, 15 and 18 sequentially.

    N.B. For clarification the 6th month’s invoice is classed as the first invoice you receive on or after you have had the phone for a period of 180 days from the date of connection. The invoices for month’s 9, 12, 15 and 18 are therefore those you receive 3, 6, 9 & 12 months subsequently.

    To claim your cashback you will be required to send us your original invoice from your network for the month you are claiming for, which must be received 14 days from the date on the invoice (inclusive), along with a letter requesting the cashback to our address as below:

    Cashback applications will be processed within 28 days of the date of receipt. Where a Cashback is claimed in instalments, claims for subsequent instalments are dependent on acceptance of the previous claim. Where a cashback is offered as a line rental discount, the value of the cashback is calculated on the original tariff selected. Please note proof of sending is not considered to be proof of receipt.

    It really makes you mad that they break the t&c without consequence but fall foul of them yourself and they're quick to quote them.

    My 2nd cashback payment was paid to me 105 days after submission. According to their t&c this should have been "28 days of the date of recept." :mad:

    trouble is their 28 days are working days i.e. don't include sat/sun or bank holidays. our 14 days do. just got my 1st cash back roughly in time scale. the letter i sent quoted their own T&Cs & dates i expected payment by.

    just wondered whether there should be options for 1st 2nd & 3rd cash backs? as i have received my 1st but don't want to cast a vote to give them the benefit of a received all vote yet, as until i get them all i am not that confident. i have voted none of the above but don't feel that is of any help to anyone considering them.
