I had to issue legal proceedings to receive some/all of my cashbackP2U have filed a defence against my claim and have mentioned a case of Mrs Kamlsh v Phoned 2 U Direct. Does any one know anything about this case has any one else issued and been to court or did they settle after they filed a defence?

Because of errors on my part I've lost some/all of my cashbackI am one of those unfortunates who have fallen foul of their '6 month' /180 days invoice rule. I sent my 6th monthly bill quite promptly only to receve a letter in the post well after the next month deadline has passed saying that the invoice sent is previous to the one needed to claim. Am furious at their misleading terms and conditions. Is there anywhere I could complain about it?0

I have had similar issues but I sent the 5th and sixth bill just in case. The first was returned saying it was incorrect but I didnt get this until after I had sent the 6 month bill - so take a tip - at the 180 day mark send 5th bill as soon as you get it and then send the 6th - if you still have no reply send the seventh!
It has taken and average of 90 days for them to pay the cashback and usually after sending a recorded delivery letter giving them 14 days to pay before legal action is taken. Previous to that I have experienced the usual phone tactics and lack of email response. I am still waiting for the last 12 month claim from the end of Feb 07 but the letter is due to go tomorrow.
I will not use this kind of scheme again and have gone to O2 direct this time.
My wife has a contract on Dial-A-phone and we are on the third one and have never had cashback problems. They usually pay withing 7 days.0 -

BEWARE OF PHONES2UDIRECT CASH BACKCLAIM
My cash back claim for 210 rejected in May 2007 due to porting of number in O2 network. Although, I telephoned and informed in October 2006, now they are asking me to provide the time and date of call made to them.
In addition, they charged to my credit card with 340 on the pretext that they lost network subsidy.
Please beware of cash bakck claims of Phones2udirect. They try maximum not to pay the claim.

ive got may 2006 (3.1) which is probably the same if you still need them.
on another note ive just recieved my final cashback (on time) from them so i am happy. to be fair i had a bit of a delay for the 1st one but the last 2 were on time. i told them the day i should receive the cheque by in my letter & quoted their T&Cs to them & said if not recieved i would not chase it but issue court proceedings & claim costs. that seemed to work.0 -
