  • I wanted advise about where i stand with balifs, what they can/can not take, advise on approaching CC Companies, links to sites, etc. .

    The BBC website has a section on debt here http://news.bbc.co.uk/1/hi/in_depth/business/borrowing_debt/default.stm
    There is an article about dealing with bailiffs at the bottom, plus some other stuff that might be useful, and offsite links to other resources. Hope this helps a bit.

    No you never said it was easy, i was just saying it aint fun, lol.

    We dont have huge luxuries but we also have no debts, we pay for everything as we need it. We just have huge shopping and clothing bills as we have 4 boys.

    OP do you have other credit cards? Is she allowed to use them? Might be worth checking your statements. i would also be wary of any catelouge (what is up with my spelling today?) debts and stuff like that.

  • One thing about this thread especially surprises me - there have been a wide variety of replies, some of which have obviously been written with the express intent of helping the OP. For example, when he said that he was hoping for advice in dealing with bailiffs etc, someone immediately posted back with practical advice (don't let them in the house) and someone else pointed to a helpful bbc website.

    Is the fact that the card is in the name of a person who doesn't exist relevant? I know it's a bad way to think but maybe there is a way to eradicate the bill completely? The person doesn't exist therefore there is no one to pay it?

    I do feel for you as you're obviously feeling very left down by your g/f.
    I'm by no means any expert but I do think you really need to try and establish exactly what is owed and to whom .. Can you be sure the Capital One CC is the only debt your g/f has?? I think the suggestion to get a credit report for you and your g/f would be a good starting point to establish what debts there are. If you read through the MSE tips there is a draft letter which you can use to apply for your report at a cost of £2. Without meaning to sound alarmist you need to be sure this is the full extent of the problem and there are no other surprises around the corner.
    I was in a situation when I was teenager where my dad left and we had huge debts that he'd run up before he vanished and my mum and I had to try and pay as best we could. This went on for nearly 10 years before the word baliff was mentioned, thankfully we just survived by the skin of our teeth but we're still paying.
    I don't know the full extent of your situation but, if you can, sit down with your g/f and start to work out how you are going to sort this mess out and get a few payments made then I'm sure it wont come to baliffs if you act now.
