You can start your investigations with this Watchdog report on the Martin Cutts case. http://www.bbc.co.uk/blogs/watchdog/2012/04/excel_parking.html

Copy (minus personal data) of email/appeal I have just sent...

    Dear Sir/Madam,

I received a 'Letter' today in the style of a PCN for apparently contravening Your not very clearly marked Parking procedures at The Peel Centre- Stockport on the above date at 16:42. I was there at the stated time with my partner which was our first (and final) visit and didn't see ANY signs stating that it was a 'Controlled' Pay & Display area (not Very controlled in my opinion by way of informing customers and giving people clear signs, Very Controlled However by way of cleverly issuing 'PCN's' to unsuspecting shoppers and reaping the revenue from said tactics). A Pat on the back should be due for the top dogs in your company who are probably sat on a Yacht in their Budgie Smugglers somewhere hot, sipping Martini's and constantly checking their Bank Account App to see if they have enough yet to buy a small Island.

I have visited the car-park and taken photos for My Defence and am gathering enough evidence to support my case, I'm pretty sure you must have cottoned on by now and worked out that unfortunately I refuse to pay your Bosses 'Starter' in the Club Tropicana by way of paying this PCN and will be ignoring (but keeping) ALL begging and threatening letters to take with me to Court.

Thank you on behalf of myself and many other bewildered shoppers for your nice letter but I am not as gullible as some and refuse to line your pockets for something that is Your fault.. Clear, Legible Signage all around the Car-Park would save many customers from either losing money or losing time in their life communicating with Money Grabbing Companies like yourselves.

P.s. Please pass on this link to your Bosses and tell them, if they give the Beluga Caviar a miss for the next couple of days then they would be able to fund some more signs.... *signage company link*

    Yours Truthfully

Stu - the second part of your post is the real thing.

If it ever gets to a court - and it probably won't - then you will need to get rid of the emotive subjective bits and stick to the facts. The chances are the judge may have a bigger yacht! :rotfl::rotfl:

Got one of them letters from excell in the peel center on my mat at home today. On the day i did park up for about 40 minutes but was just sat in the car enjoying a coffee so as i wasnt going to leave the car i didnt get a ticket. i didnt go into any of the shops, just sat there.

Course the letter is saying its a PARKING charge notice but the only thing thats on the page is a couple of pictures of my car going in and out of the car park. I was part way through an email to them saying id pay IF and only IF they could supply me with photographic evidence of my car parked up and also a photo of my dash without a ticket but then i decided to check out the site and now im doubting wether or not to reply at all.

if they want to charge me for parking then surely they should present me with evidence that i was parked shouldnt they? if all they're doing is showing me entering and leaving then regardless of the time frame surely asking me to pay for parking is contrary to their evidence isnt it? its like going into a pub, not buying a drink then being charged for the tax on a pint when you get home.

i want to ignore the letter like so many have said but i also want to see if they would jump through hoops to try and convince me to pay when they havent got any other evidence to force my hand. what should i do????
