I agree the cashback delays can be frustrating but this is never something I have considered having to take legal action for whether for myself or on behalf of any of my customers.
Conclusions are being drawn that these delays imply financial difficulties. There are some regulars on the forum who appear to actively want MS to fail. Thankfully most of the posts containing misinformation and wild speculation have now been deleted.
Personally I don't think they are in any financial difficulties. I doubt MS would have recently hired a new web designer to overhaul their website if this was the case. Just an example that everyone can see. And if I knew they were in trouble, I would certainly not be investing time and money into promoting their service.0 -
If they are not in any financial trouble as you claim, this makes it even worse. They should therefore have no excuses for their poor customer service and blatant disregard for their own cashback terms and conditions.
The fact that they cant even give a valid timeframe of when they intend to start paying is ridiculous.
Certainly not a company I would do any business with again, throughly unprofessional and poor handling of the entrie cashback situation, from the size of this thread I think many people will be thinking the same.
The fact remains they dont inspire much confidence that customers are likely to recieve their money infact the situation gradually seem to be worsening rather than improving. Legal actions and trading standards complaints seen the only way forward to let such companies know they cannot get away with treating customers in such a way.0 -

You say you haven't considered taking legal action on behalf of your customers. What sort of relationship would you expect to have with MS if you started suing them for money your poor customers are legally entitled to?
You say they have no financial difficulties - if not, they soon will be having them, as only a fool would now enter into a new deal with them (or you) hoping to get paid out over the next year.
This situation is being made worse by the actions of MS in refusing to discuss the problems, and sending out this next to useless e-mail.
If we take legal action, we would win, but it could just be a hollow victory if they have no money to pay out, and mean our losses are increased by the court costs.
Alternatively, if they have the money, why would any respectable business push its creditors into taking legal action against them knowing they have no defence, will lose all the cases and end up having to pay court costs on top of the money they owe.
It all points in one worrying direction.0 -

But as they make a loss from successful cashback claims this may not be a bad thing.
Less people taking out cashback contracts means less loss making contracts and more profitible ones, hence better financials.
If I am taking out a normal contract, the financials of the company are not important if I can go to the network with any issues.
I just wanted to get away from what appears a common misconception that cashback contracts are good for a company; in the days when people have electronic reminders, there are a lot more successful claimants than there used to be. It is probably not a coincidence that the number of cashback alternatives that MS offer is currently just the one on my last look.Toyota - 'Always a better way', avoid buying Toyota.0 -

Can any knowledgable person who has instigated legal action against this awful uncaring company, please advise as to the procedure.
I am sure many people wish to take this action but maybe unsure as to how to go about it.
It's about time they get their deserved cummupence.
As for the people who keep defending Mobileshop and their contempt for their customers, WAKE UP!0 -
I have used the BBC watchdog site to post my situation - if more people posted I'm sure they will launch an investigation in Mobileshop and maybe we will get somewhere with them.0
