You can if you ask to, they will also more often than not have a display model that you can look at, you cant look at it if it is in the box can you.
True, but thats the point, you don't have the ability to do that over the phone or web, hence the need for the DSR. THE DSR is to protect you from the fact you can only inspect the goods after you have concluded the contract.
In store you can ask these questions and take a look before buying. If the shop opens the box and you don't buy it that there problem not yours. If you buy it instore without checking and open it then change your mind it's too late.I think the fact it hasnt gone to court tells you all you really need to know about this.
Not really, it just means no-one has challenged it.
Most companies have a better returns policy so it's never needed to be challenged. The problem with mobiles is it's not really a single contract. There are two contracts, one for supply of hardware, the other for the airtime agreement. They are only connected in that the hardware is an inducement to take on the airtime side, after that they are seperate contracts. You cant cancel the airtime if the phone is lost, stolen or damaged.
You could take the view that if you get a free upgrade and decide you don't want it and return it then you are still bound by the airtime side, as it's a seperate contract.
However Mobile contracts are not a simple contract, and hence unless it's challenged it's not clear what bearing the DSR has on them.0 -
Decided to bite the bullet and get an iPhone 4. Orange website was showing stock as available, I have a PAYG number to transfer across so phoned up, as we were going through the order stock ran out however was told that Orange are getting deliveries every day, was told I would get a call when my order is ready to ship. I think I will give them a week and if nothing shows up phone again to cancel. We shall see.0

And if the online store sends you the item and you open it and return it, it is their problem and not yours.

Received my phone yesterday. (Fantastic by the way)
It was meant to transfer from my previous contract with orange.
It turns out they have started another contract on the same account. So now I have the number everybody has on my old phone and a new number on my iPhone.
After speaking to them apparently I have to go and get a pay as you go sim so they can transfer everything across...0 -
Really? Seem to be an awful lot of people suffering from this here:

Oh N20Y1D I'm not sure i've ever come across someone so obsessed about the iphone even though they don't have one and slag it off at every opportunity :rotfl: I'm kinda thinking your getting very jealous of us all with our amazing phones.
Which forums have you been banned from now N20Y1D? I wonder if you can get banned from MSE too! :T
Did you miss the headlines that Apple sold 1.7 Million iPhone 4's in 3 days and in just 5 Countries lmao.
I'm guessing with 1.7 million new iPhone 4 users some will be having problems as with every handset ever released. Why don't you list the problems people have had with the HTC Desire? It is your phone at the end of the day. While your at it why not post the sales figures for the Desire.
Not having any problems with my proximity sensor lolHardcore moneysaver0 -
Hi,
Not sure this is the right thread to post this but just after some opinions/advice. I already have a 32gb Ipod Touch and I'm thinking of getting the Iphone 4 to replace my Nokia N95. The thing putting me off is now that I have read the reviews and stuff is there really any diference between the Iphone 4 and The Ipod Touch other than the obvious one being that the Ipod is not a phone!!? In other words I'm not sure whether I want to pay £349 (on the Tesco 12 month deal) if the only real difference is the calling/texting/camera as any old phone could give me that. I realise I could always sell my Ipod and the Iphone would give me everything the Ipod did plus more but I use my Ipod as the main household music player and not sure if this would be very practical if I was using my mobile for this. I've also been tempted by some of the reviews of the HTC Desire, does anyone have one and would this give me anything particularly different/better than my Ipod or the Iphone?
Any comments/info appreciated, I'm quite indecisve incase you didn't notice!
Cheers0 -

Correct.
As I said before you you buy over the phone or web then you have the right to examine it and if it's not as you expect return it, but it's not a trial period, it's an examination period.
My comment above clearly said if you buy it instore and change your mind after leaving the store (actually even if you don't open the box it's the same) you have no rights to return it. You may get a goodwill refund but you have no rights if you change your mind.0 -

Don't forget that you have the 3g connection, GPS, better screen, faster processor and better battery life - and that's just comparing it to your iPod!!In the beginning, the universe was created. This made a lot of people very angry and was widely regarded as a bad move. The late, great, Douglas Adams.0 -
cheers OTG, that's the kind of info I wanted! I think I really just want convincing to buy it!
I still quite like the look of the Desire though and that would be wuite a bit cheaper, the Iphone 4 is definitely better looking though! I'm waiting for the white one but can see this been a bit of a wait if it's not out until "2nd half of July" and even then they might sell out pretty quick.
ps What is better about the 3g connection is it just a lot faster?0 -

Not much joy i'm afraid
Ps I only tried to order one phone not two
Another part of the email says basically go to your local Tesco to buy one
I was sorry to learn that you have been unable to order a new iPhone 4 from Tesco Direct. I can fully appreciate how disappointed you must have been to learn that both of your highly anticipated orders had been cancelled and would like to offer my sincere apologies.
Our IT systems are set up with a Bulk Buy policy on Mobile telephones, as per our Terms and Conditions, meaning that any orders with more than one Mobile Phone is automatically cancelled by the system. Unfortunately, the fact that this phone is available with a contract as a package means that our system is currently recognising, incorrectly, that there is two Tesco Mobile products in the basket and automatically cancelling the orders.
This is unacceptable and I would like to assure you that our IT Teams are working on a fix for this to be implemented as quickly as possible. From a business point of view, it is certainly not acceptable that our customers are unable to place these orders with us at this time. In addition to the obvious disappointment that is being caused to those who have been looking forward to this launch for some time.
I am really sorry that I have been unable to give a full resolution to this issue. However your feedback has been passed to our Business Support Team who will be reviewing processes for future launches of this nature.
Thank you again for taking the time and trouble to contact us I sincerely hope that despite this unfortunate situation, you will give us the opportunity to restore your faith in our operations.
Thanks for the update. Still doesn't actually explain what happened to the stock which they apparently had 'plenty' of.0
