ive just had an email from orange saying theyve got iphone 4 handsets in stock for existing customers still- as im due an upgrade i can have one
i might just wait till the second batch come out to see if the problem is fixed
i doubt they'll do a good deal to keep me anyway-but i might ring up later just to see wot they say
ha ha, I've just had the same email and judging by your previous posts on here and on the Orange retentions thread we think along the same lines. I'm going to wait a couple of weeks then if orange won't give me a good deal I'm going to switch to Tesco. My PAC arrived this morning anyway.
any idea when the second batch is out? I go away on the 1st aug and would love to have my iphone4 up and running by then0 -

no idea about another batch theyre probably desparately trying to sell the first lot before they have to fix anymore to send out

You are allowed to use it for 7 working days. Your phone company will just charge you a pro rata rate for usage.

It depends on the network, it may be accepted it may not.
Three for example specifically state that if you use the phone then the DSR is voided.
The DSR needs clarifying. It can be read that an upgrade has no rights as it's not a new contract but an upgrade to an existing one. It can slso be read that the phone has software and by using the software then the phone becomes non returnable.
Three take the software used approach and that once used for any length of time the DSR rights cease.
Remember what the DSR is for, it's not a trial period, it's so you get see an item in person rather than a screen, for example the blue jeans you order turn out to be pink and it's down to a bad (really bad in this example) photograph. It's designed to give you a similar expericence as if you are shopping in person.

Tesco announced they would be selling the iPhone 4 on a 12 month contract from Thursday. Probably one of the best deals around. You had to call as not available online (although some stores had limited stock too).
People tried calling but couldn't get through. When they did they were told that the systems were down and wouldn't be up until the following day and to call back. People were apparently told that there was 'plenty of stock' and that they would not run out.
Friday morning and Tesco started taking orders but orders later got cancelled due to system problems. People were then told to call back the following day. Some people were told that they would be called back.
On the Saturday people were told that the systems were down and that they should call back later at midday.
By 12:10 all the phones had apparently sold out leading people to believe that there was in fact, no stock.
There also has been an issue with the Tesco have not been forthcoming with information (like on their website).0 -

They can say what they like in their T&Cs they are still governed by the DSRUnder a distance selling contract, a supplier cannot make refunds subject to the goods being returned unopened in their original packaging. One of the principles of the distance selling regulations is to give you a chance to examine the goods at home, not having had a chance to do so in the shop. It would be impossible for you to do this without opening the packaging and trying the product out. Having said this, you will still be under a duty to take reasonable care of the goods while in your possession, and may be subject to certain instructions such as not to wear shoes outdoors, or remove hygiene seals.
