HTC Desire Vodafone 500mb Fair Usage Policy

ok so I emailed back for clarification and suprise suprise I have got a completely different answer. Someone different always replys the the emails with a different answer. Heres what they said
Hello Mark,
We have not made any changes to the contract. Your contract comes with minutes and texts and the data browsing bundle is a Value Added service.
We have not made any changes to the allowance, however, we've just re-affirmed what you used to get as per the fair usage policy. There is a fair usage policy of 500 MB wherein which you were made aware and you'll still get the 500 MB of allowance each month. There is no change to the allowance that you used to get after 1st June.
You would be made aware before you have used the data bundle by text and it'll also give you the information on how the charge will go about if you exceed.
Vodafone has added the limit after a lot of survey and information that we've gathered from our customer. We have noticed that only handful of our customer go over the 500 MB which is more then enough for each month.
As per your current unbilled usage from 2nd to 16th May, you've used 21.3 MB of data usage. In May 2010, you have used 225.80 MB
In April 2010, you have used 291.92 MB
In March 2010, you have used 147.01 MB
If I refer to the past the months used, I can see that you have not gone over 300MB which means that you'll not be affected even if the fair usage policy has been taken off. We've not made any changes to your contract and so we'll not be able to cancel your contract without the Early Cancellation Fee. If you still wish to cancel your contract, you'll need to pay £xxxx as of today.
I trust this helps.

May I add that I barely used the phone due to uni for the last three months but that has changed now,

Ha! and what about the next 18 months of your contract? Pathetic!
Anyway, here's some more shocking news for you all... The 500mb of data our unlimited packages are being replaced with are (and this is from a Vodafone advert I have in by pocket which was printed today) enough for you to "watch 2 3 minute youtube videos a day".
Nothing about reading and replying to 10,000 emails, nothing about 8000 BBC news articles, nothing about 24 Google maps, or 6 interwebs... JUST 2 3 minute Youtube videos a day.
If anyone accepts that, they're nuts.0 -
Am still following this up through a number of channels. I sent this off this morning:
and just received this in response::
I am still not sure how the official statement posted on the eForum by Tom_Vodafone does not constitute notification of a change in charges?

I have just received this in response:
I have just received the following in response to my last emailKaren_Jones wrote:
Clause 11 c says if we increase your charges, as we havent increased them or given you a date of any new charges you are unable to cancel under this clause
If we notify you of a change in pricing and this would have the effect of increasing your bill only then would you be eligible to cancel.
This is our final position and response to this issue
So now they are saying that they are not introducing any new charges - completely in contradiction with the official statement posted by Tom_Vodafone in which he states that no charges existed before, but from 1st June the charges will be £5 per additional 500MB! If that is not stating that charges will be increasing from 1st June I must be reading Tom's statement completely wrong!

Hi mate,
As I mentioned before, how more official can you get than a message on their website from one of their managers?

I had a call from Tom last night and he assured me that no one was going to be charged YET and that they didnt even know what amount would trigger the charge. i said that i didnt want to wait to be charged and that i wanted to cancel before it happened, he then assured me that were i to be billed for excess usage i would be able to cancel.... which did strike me as odd.
I think that by maintaining the silent stance on the eforum they are actually doing more harm than good.
I suggested to him that they get themselves a htc desire, and set it up as a member of the 3% would ie with a few widgets and leave it on the desk with "enable always-on mobile data" "background data" and "auto-sync" all ticked and just see how fast the data racks up....
Personally i'll still be looking to cancel ASAP , given that my phone uses enough data on standby for seven hours overnight to take me over the limit in a month.TESCO EVERY LITTLE change to the t&cs HELPS0 -

You should have asked him for that in writing mate. It contradicts everything he has said.0 -

I have just sent the following in resposeAndy_Wicks wrote:have already been notified of a change in pricing that would have the effect of increasing my bill.
The Fair Usage Policy states that, if our use is 'excessive' then we will be charged for the excessive element at our price plan's standard rate:
"27. All Vodafone services offered free or under unlimited subscription are subject to our Fair Use Policy. If, in the reasonable opinion of Vodafone, your use is excessive, we may ask you to moderate your usage. If, after we have asked you to moderate your usage, you fail to do so, we reserve the right to:
(a) charge you for the excessive element of your usage at your price plan's standard rate;"
On the eForum, Tom has stated that Vodafone define the term excessive as any usage above 500MB per month
"2) What constitutes 'excessive'?
It's anything in excess of 500MB on a standard Mobile Internet bundle. " (http://forum.vodafone.co.uk/forum-53/announcement-137-mobile-internet-charging/)
On the eForum Tom, along with others in the past, have confirmed that an out-of-bundle charging structure does not currently exist for price plans with the 500MB FUP in place.
"There isn't currently a standard rate published" (http://forum.vodafone.co.uk/forum-53/announcement-137-mobile-internet-charging/)
That means that for Vodafone to be able to enforce their existing Fair Usage Policy they will have to introduce a new charge.
On the eForum, Tom has confirmed that an out-of-bundle charging structure of £5 per additional 500MB will be introduced.
"11) Could you also confirm at what rate we will be charged? Is it still £5 per 500mb, and if so, where is this rate written into the contract we agreed?
Yes, it's £5 per 500MB" (http://forum.vodafone.co.uk/forum-53/announcement-137-mobile-internet-charging/)
From all this evidence it is clear that Vodafone are introducing new charges. As the introduction of these new charges, and the process in which they will be applied, will put myself at a significant material disadvantage, I am entitled terminate the agreement without incurring penalty charges.
Let's see what excuse they come up with this time

When you get a reply mate let me know. I'm getting pushing about via their email system with someone new giving me a completely different reply each time and all contradicting each other. I want to cancel my contract. Just don't know the right way to go about this yet.0

All my emails seem to be being answered by one of the team leaders in one of the call centres with whom I spoke last week. I think they are starting to get annoyed with my persistence now!
