Sent the following letter earlier on today
I am writing concerning the text message I received with this link (live.vodafone.com/zr/sa1) detailing the changes that Vodafone are introducing on the 1st June 2010 when you are introducing "Out of Bundle Charging" on mobile internet usage and removing my "Unlimited" Mobile Internet plan along with the Fair Usage Policy.
This is a change from the "Mobile Internet" package that you sold me when I originally took out my contract with Vodafone.
In line with clause 11(b) detailed within the "Vodafone Pay Monthly Airtime T&C's". I wish to end my contract with Vodafone early as these proposed changes will result in an increase in my monthly payment based on my usage and I do not wish to accept the new terms.
Please can you therefore provide me with a PAC Code for mobile number ********** in order that I can port my mobile phone number to a new operator.

Yes, I do understand what you're saying and this case, Vodafone will review your bills for the next three months after the change has been applied to check as to how 10% increase has seen on your bills.
Once the review is done, I'll be happy to comment on the cancellation as now its too early to comment on the cancellation without ETF. If cancellation cannot be done, then we will change the price plan to ensure you cost effectiveness on your bill.
I would like to stress that as a business Vodafone is offering its existing customer deals that are lucrative and you can leverage maximum benefit from them and we have also received positive feedback from our customers about it. We strongly believe in finding ways to offer you more with new products, incomparable service and even more added value all the time.
Request you to cooperate in the interim.

Have written this letter back
I do not wish to wait for three months after you introduce the changes as you are fundamentally changing my mobile phone package and not adhering to the contract that was agreed when I took it out. If you are not part of the cancellation team then please forward this to them because I believe I am perfectly within my right to cancel as stated by Tom Rushton, Vodafones E-forum and Web Representative(forum.vodafon...post__p__389139)
I wish to give you 30 days notice in order to cancel my mobile phone contract on account of Vodafone breaching Clause 11b of the Pay Monthly Airtime Agreement (online.vodafo...pageID=PTC_1111) which states
“You may end this agreement by writing to us if:
· we don’t do something fundamental that we should have done under this agreement (for example, if there is a complete failure of the network for seven days in a row due to something we have done), within seven days of you asking us in writing;
· we tell you that there will be an increase in the line-rental charge by more than the increase in the retail price index (worked out as a percentage) since the last line-rental increase and you write to us before the increase applies;
· we increase your charges in the UK which have the effect of increasing your total call and usage charges (based on your usage in the previous month) by more than 10% and you write to us before the increase applies; or
· we change this agreement to your significant disadvantage including changing or withdrawing services (we will tell you if this is the case) and you write to us within one month of us telling you about the change. This does not apply if the change relates to services which you can cancel without us ending this agreement.”
You will be making changes which increases my monthly charges by removing my unlimited mobile internet package and replacing it with a fixed 500MB limit. My last months usage was in excess of 500MB and my charges would increase by more than 10%.
I will not pay any early termination fees on account of Vodafone who is breaching the core agreement and I will not be returning my phone.
If you refuse this I will raise this with Ofcom and Consumer Direct and seek legal advice.

I took out a new contract with a desire about a month ago and it clearly says unlimited with fair use of 500MB.
I emailed Vodafone yesterday saying i was unhappy about the new hard cap and that it is likely to increase my bill, based on usage from my previous smart phones (non vodafone). They so far seem to be letting me cancel my contract. I have made it quite clear they were in breach of the terms and conditions i agreed to and that i want to cancel without penalty and without any further payments beyond my current months usage. Whether they actually took in what i was saying is another matter, im still expecting them to try to charge me for the rest of my contract.0 -

Obviously I am approaching it from the angle of it increasing my usage by 10% and, Vodafone themselves have said we can cancel if this will increase our charges by 10%.
For those arguing that it will significantly disadvantage them, they would need to approach it differently.

I think i'll try CS again this morning and find out where i stand. If they can offer a suitable compromise then i'll take it. Not surprised as to not receiving a reply to my email as yet as it was a sunday and i would imagine that they are swamped.

When people say refer to their individual T&Cs, where exactly are these? I upgraded via web relations over the phone and my bills are paperless so nothing get's posted to me.0
