I saw the quoted email from LeeH of the Eforum team on page 69 (regarding sending back the handset if you cancel using the 10% rule.
This surprised me as I recieved a welcome email from Voda in Dec 09 when my contract started, and tacked onto the end of the mail were the terms and conditions.
Here is part of section 11 entitled 'ending the agreement'11.4When this Agreement comes to an end:(A) we will disconnect your Mobile Device (which you may keep);
(B) you will have to pay immediately all Charges outstanding at disconnection; and
(C) if this Agreement ends before the end of the Minimum Period, you will have to pay us immediately in one lump sum the remaining line rentals for the rest of the Minimum Period. You will not have to pay us any further sums in respect of the Mobile Device or any of the other cancelled Services.0 -

I have an ongoing dispute with 3 uncannily similar:
Out of contract with 3 from last January, with history of network probs, poor service, the usual. . . I was ready to leave.
Requested PAC codes over 3 separate months,
Delayed leaving ONLY as couldn't find a new phone I liked enough.
Finally, iPhone 4 enters market, and HTC Desire.
Definitely time to go.
Rang 3 to request PAC code yet again; end up talking to 3's customer retention enthusiasts.:(
Long story short ~ much haggling over proposed deal, 24 months, BUT
"UNLIMITED internet use" was promised. No cap.
Youtube, movie clips & iPlayer were all discussed.
After all, you don't want a fast car just to sit in the garage. . .
Call me naive, but there was no mention by 3 of capping the service, so. . .
24th June, I agreed deal on basis of above,
HTC Desire arrived, but remains unconnected, because (guess what) :
yup, without informing me, :mad: , 20 July, still using old phone, discover a cap of 500MB is on my account.
Rang 'em to query.
3 AGREED their sales team had indeed been MISSELLING "unlimited" internet (they thought it means "limited", apparently:rotfl:) , and they'd been TOLD TO STOP.
"As a special goodwill gesture" to a good customer, they offered to put my cap up to 2.5GB. Huh?
Not good enough, I say, stick to the contract we agreed.
~ Too long on phone to them, so, expressly reserving ALL my rights, said I'd give it a few days trial.
10 days later, (using Nokia 5800, btw), & with just 30-minutes-odd tentative net access via 3 network, they say I've used 500MB :shocked:
If connection @ max 5800 speeds of 3.6mbps, (=0.45MB x 60 =27MB a minute,) MAX, so just 18 minutes flat out would use 500MB .

HTC Desire runs twice as fast,
Fair use ?!?, schmare use, seems to me money lies deep at the heart of all this, and if it looks like a ripoff, walks like a ripoff, and talks like a ripoff, that's just what it is.
I smell collusion between the networks to maximise profit.
I hadn't done any sums on this before (~why should I?, unlimited use in my deal, plus I wasn't planning any heavy use at all).
However, grr, since:huh: 3 now want to change the contract we'd agreed, & we've hit an impasse (they're considering their position right now), I've worked out what UNLIMITED should actually mean on an HTC Desire running at 7.2mbps:
Averaged over the year, it's
2,309.765625GB a month :T:j
And you can quote me on that
Now (hello 3, hello Vodafone) I'm not realistically expecting 2000Gigs a month, but apparently, that's what your offer to me actually means.
I agreed to the deal because I wanted to cap my spending, not potential use.
In truth, of course I'd settle for some sensible arrangement that simply addresses just that.
But if 3 won't make a sensible offer to resolve matters, at a nominal value of £1 per GB, perhaps they can be sued for £2309 x 24 months = £55,416 to buy out my contract. . .:beer:
Meantime, I am available for weddings, funerals and barmitzvahs.

Mate do i thing connect that sim to the desire. On 3 if they say you have 2.5gb then download 3g watchdog app tells you how much you have used! I think they are talking rubbish tbf you cabt use 500mb that quick0

me too, have been using, at least 4gig data a month, and all am getting, is just texts, stating, i should ring customer services, to arrange a data plan, as i have gone over, and still no much needed call.0

I got a blackberry from vodafone back in november and thought I was on an unlimited data tariff. This is the first month I will prob go over the 500MB limit and im concerned im going to be charged for more data. Previously it wasn't an issue because i had wi-fi but now i rely on my phone so have been using it a lot more than usual. If I am charged £5 for more data next month would i be entitled to cancel my contract as the charges have increased by more than 10%. unsure what they mean by previous usage as what i used last month is irrelevant. Also the data charges came in on the 1st June although I only heard about when I was talking to a friend the other day. Ive had no notification from vodafone.0

Yes you will be entitled to cancel. The moment they inform you of any charge tell them you wish to cancel your contract without penalty.TESCO EVERY LITTLE change to the t&cs HELPS0 -
I also have got 3 warning texts for the 3rd month running now but still no call. To be honest it looks like there will be no chance of cancellation.0

I don't really care about the cancellation as much as unlimited internet. VF have essentially shot themselves in the foot as I tried so hard to keep below their FUP previously, since this move it has signalled the green light for me to use my phone as I please. Since the cap on most other networks, particularly O2, I think even if we don't get this call and we continue not to be able to cancel, it is still a good deal getting uncapped internet.
I very much doubt I will get a phone call either, but since I am using whatever data I like I don't really want that call now.0
