this is the offical word from one of their mods, about keeping mobile should anyone want to cancel for being charged
Hey all,
I'm sorry for the delayed response, but the official word is as follows:
If your bills have increased by 10% or more because of the data usage charges, you will need to write in to the address posted in the Data Charges Announcement , proving that the bills have increased by 10% or more based on the same usage month to month.
If your bills have increased and this can be proven then we would need to assess on a case by case basis if the phone is to be returned. This will be depending on whether we advertised the phone for free or for a fixed price.
The information around the data charges is in the linked Data Charges Announcement.
Cheers,
LeeH

There is nothing in the T&Cs about returning the phone, rather there wasnt, they have rewritten the T&Cs for new contracts and have now included:
Pay Monthly Airtime Conditions (from 7 June 2010)
http://online.vodafone.co.uk/dispatch/Portal/appmanager/vodafone/wrp?_nfpb=true&_pageLabel=template12&pageID=PTC_1529
d) When this agreement comes to an end:
we will disconnect your mobile equipment from our network (you may keep the mobile equipment, but may have to make a payment as described below);
you will have to pay immediately all charges you owe on the date we disconnect your mobile equipment from the network (including any charges for additional subscription services such as content services); and
you must still pay all the line-rental charges until the end of the minimum period. This applies when this agreement comes to an end in clause 11, except in the following situations:
- if we ended this agreement under clause 11a; or
- if you ended this agreement under clause 11b; or
- if we ended this agreement because we were permanently unable to provide the services to you,
in these three situations you do not have to pay all line rental charges until the end of the minimum period but you may have to make a payment in respect of your mobile equipment. We will let you know in your order form or welcome letter or welcome email if your mobile equipment is subject to such a payment and provide you with the original value on which that payment is based. The payment will be 1/24th of the original value of the mobile equipment, less any initial payment you make towards it, multiplied by the number of months remaining until the end of your minimum period. You will make this payment to us immediately on request following the agreement coming to an end.
And what the old T&Cs stated:
Pay Monthly Airtime Conditions (pre 7 June 2010)
http://online.vodafone.co.uk/dispatch/Portal/appmanager/vodafone/wrp?_nfpb=true&_pageLabel=template12&pageID=PTC_1111
d When this agreement comes to an end:
we will disconnect your mobile equipment from the network (you may keep the mobile equipment);
you will have to pay immediately all charges you owe on the date we disconnect your mobile equipment from the network; and
if it ends before the end of the minimum period, you will have to pay us immediately (as one lump sum) the line-rental charges left for the rest of the minimum period. You will not have to pay us any more for the mobile equipment or any of the other cancelled services.
e If this agreement ends before the end of the minimum period and you pay us the line-rental charges for the rest of the minimum period in one lump sum, we will reduce this line-rental payment by a rate we set. You can ask us how much this rate will be.TESCO EVERY LITTLE change to the t&cs HELPS0 -
be very wary people, in June i got 3 text messages only to find out my usage was 250mb with them saying i had gone over, obviously i hadn't.
As payback my next months usage was 2.87gb :rotfl: that'll show them for lying to me. No warnings or messages last month and my bill was cheaper than im supposed to pay:T0 -

I had this too. I never even knew about the FUP until I started getting texts from Vodafone saying I'd exceeded it. But when I phoned them to query it, I was told I'd used less than half that amount (although I still ended up going over the limit by a fair amount that month).
I've gone over the limit two months running now, so presumably they'll start charging me if/when I go over the limit this month, which I almost certainly will. Not had any warning texts for a few weeks though, or the promised phone call to discuss my options.
I've also had an offer from Vodafone to increase (for free) my cap to 1GB a month, but I'll probably decline this. I'm still waiting for them to confirm, but I'm assuming that it's a hard rather than soft cap, and also, since it's post June, that I'll no longer be able to use the 10% getout clause that was in the contract before then.0 -
Just had my text warning for the third month in a row. What now? lol0

Has anyone actually been charged yet?
My internet usage has been at around 2gb, I checked my n900 and I pretty much use about 30mb per day just being connected to 3g, never mind Skype being active or anything else.
I want to know how it is possible Voda could ask for phone back, its not me breaking there T&C its them, therefore how can they possibly have the right to ask for the phone back!??!0 -
Can someone repost the email for the Director's office? I am getting nowhere with email support for the misselling of the 1 Gig FUP policy, no reply.0

Google Guy Laurence.
As far as i am am aware there is no such thing as a 1Gb FUP policy. It's 1024mb allowance with a hard cap0
