Came across this information on this site. Very interesting apparently the FSA are clamping down on the banks to stop them raiding accounts to pay of debts. Have sat down with the OH this week and managed to work out, and accept, that there is around 60K that needs to be paid back. :eek: indeed!
Contacted CCCCS and have arranged a DMP which should see us right in the next 5 years with monthly payments to creditors of 1k shared between them each month.
Have been to Halifax today and opened new accounts and cancelled all direct debits that would normally pay off our debts.
Just so I know I've got this right, next month, our wages will go to our new accounts, all those we owe money too will send us a letter (because they won't have received their direct debits) and we make a token payment until the DMP kicks in??
Have read a couple of pages of this thread - Sounds like I'm in the right place!!:T

Well PayDayUK, or the DC arm of them are refusing to deal with CCCS.
I've replied yet again saying I will not/cannot pay anything outside the DMP and that maybe its better if we go to court and we can get this over and done with. I'm getting fed up with going round in circles.
All this for £400. If they take me to court Iwill argue my case in person amd if the judge makes me pay more than the CCCS figure I will use my Emergency Fund to pay the thing off. Is that wise?

Eyeopener - chances are it won't get to court, it costs creditors too much. Even if it does the judge will see that you are doing everything that you can to work towards paying things off and won't stray too far from what CCCS have already offered.
You are right though they are idiots.
I know it's really hard at the moment but it does all calm down once a few payments have been made.0 -
I'm sure I read somewhere that it costs around £1500 to take someone to court, so doesn't seem likely, you're right they are just idiots. I would write again, quoting the guidelines and if they don't play ball, phone and report them to the FOS, its really simple, you just phone, they take a verbal complaint, they guy agreed I had something to complain about and forwarded it to Amex. They have 8 weeks to sort it out from the date of complaint, if you're not happy with their answer, it goes back to the FOS and they take it from there. it stands to reason that the banks/creditors can't want loads of complaints against them so the more the merrier, I have just decided I am not taking any !!!!!!, thye've had huge amounts of money and if they don't play ball, neither am I.

Depends, have they really passed the debt on or is it an 'in-house' collections dept trying to make itself look like another company? If it REALLY has gone to a different company let CCCS know. If it's same company just next desk along file it with the rest
Hope this makes sense to you 'cos I think I've just managed to confuse myself, think I may be getting tired ...
