Without a paddle... support for anyone starting a DMP in 2010 (part2)

Afternoon everybody
Well, well, well. Payday UK have refered me to a DC, I think its the inhouse one and I just replied via eamil, that I didn't have any cash and yes I was quite aware that my credit rating was trashed and I didn't care oh and wouldn't be easier for us all if PDUK just accepted the DMP.
Whether it makes any difference or not I don't know, as I am in the system of letters now so no doubt will be deluged over the coming weeks. I await the red ones in big bold lettering.
I did say to them that I would prefer them to write as any defence in court will be reliant on letters rather than email. I don't know if thats true but it looked good on the reply.
Ah well, into another pointless battle that may or may not end up in court. It certainly changes your outlook on these things when you don't actually care because you are making payments and they cannot have what you haven't got.
I will keep you informed of any progress or not on this because I think they could start threatening me. Ooooohhh scared, not.I'm Debt Free :j 2/09/2013

I just pick the vibes off this site really. The way I look at is that I am trying to pay back what I owe, and I will pay back what I owe but if they keep ignoring what I say, or ignore CCCS then I will just get stroppy and use whatever weapon I have to annoy and frustrate them. Even if it went as far as court I would use every possible tactic to make them look stupid. While still payig back what I owe.
If i was running away from my debts, fair enough, hound me, harrass me but not when i'm actually paying you money albeit at a reduced rate!
Anyway i've had a reply saying they want confirmation that i'm with CCCS, I was going to say they could walk down the corridor and ask as they are in the same building as PDUK (google is a wonderful tool), who already have the info, but thought better of it.:pI'm Debt Free :j 2/09/2013

och Eyeopener, I would just go for it. If you need to develop a more sarcastic turn of phrase have a read through some of Never-In-Doubt's on the unenforeability thread, they're masterpieces and he doesn't hold back and hit the wall!!!

My understanding is that the creditor should write to you and notify you that they are handing the debt off to a DCA and they must name the company.
Remember DCA have to work within the same guidance as Banks and Building Societies. Here is a link to the Lending Code which most Banks and Building Socieities have subscribed to http://www.lendingstandardsboard.org.uk/docs/lendingcode.pdf
See section 9. I have recently referred to this document and found it very useful in dealing with a creditor.
Remember Eyeopener2 they cannot have what you have not got.

Good evening folks, an interesting development today.
Finally had enough of BT Broadband/Phone/TV so I rang Virgin to get a better deal, which they offered for a better price.
So great I thought, save some money, etc.
Then the chap said "Am just going to run a credit check"..............well that's the end of that I thought.
3/4 minutes later he comes back, "No problem Sir, here's your account number, etc, etc".
I have at least 3 defaults and am on a DMP, very strange indeed. PPLBM Jan 2010. DFD 2016. :think:

Hello all, just checking in to read everyones posts, glad everyone seems okay.
Eyeopener- I know how you feel about pd loans I am in the same position with wonga,the passed me on to their "solicitors" who funnily enough have the same phone number as wonga and use really badly printed letter heads! I'm not really
Scared by them any more.
I had a really good chat with my husband last week, he knows I'm in a dmp but not all the details,so I I've explained it to him and he's been so good about it all, really understanding.I don't know why I've kept it from him so much, I was really embarrassed but he said he was just glad I was okay and I glad I used spending as my release (I went through what was probably depression) and he was gla I didn't do anything else to hurt myself.
Anyway had a letter from Barclays today to say my current account will be closed in august.I'm not too worried as I have already move accounts but rang them for more info and they said my offer would be declined if thy did not close my accounts, which is weird as they had already sent me a letter to say it had been declined!?! Oh well I just think that the longer they mess around with accepting etc gives me more time to pay off debt!
I also realised I had given cccs the wrong account number and my cccs money was sitting waiting for them so had to give them a call and the pay by transcash again this month but I've paid and that is all that worries me, just annoy with myself for getting muddled up but never mind I've been a bit stressed!
Anyway all my household bills are paid this month except for the council tax arrears, I rang and explained I was struggling a bit and they kindly agreed to spread
My arrears across the remainder of the year so can breathe a sigh of reliefand my mortgage arrears are all paid off too
Just have arrears on my car now but will hopefully be able to sort that next payday and I'll worry about that then.I'm still mega skint for the rest of the
Month and helping friends drive the three peaks challenge this weekend, but won't need to pay a penny- so get a weekend away for free ( even ini won't sleep for 24 hours!)
