  • My disabled mum received a parking notice on the 14th Feb at Robin Retail Park in Wigan as her disabled badge had slipped off the dashboard. She was parked for 16 mins. I contacted CMS online and by letter but of course the parking notice appeal has been unsuccessful.

    I am just about to pay the notice fee of £55 which increases to £90 if not paid within 14 days but then saw your posts.
    Can anyone tell me where my mum stands on this issue? Should I pay the fine?
  • I think you should pay fines. But since this is simply an invoice she can do the same as the rest of us and simply ignore it

    Her appeal was unsuccessful. The Pope is a Catholic. Bears poop in the woods. MSE posters don't pay speculative invoices.

    I know my post looks sarcastic, but it's not meant to be and I hope you feel reassured that you can safely ignore the scammers.

    For a start it's not a "fine" and your mum doesn't owe them a penny. From now on ignore them and don't respond to any of their silly letters.

    CMS have no authority at law to fine or otherwise penalise anybody. Were you to ask them that direct question they would not deny it. What your Mum has is an invoice, or in strictly legal terms, an "invitation to settle" a breach of contract CMS will allege she committed by failing to display her blue badge as their signs require. Firstly, the BB scheme does not apply to private car parks (which this must be - CMS do not do decriminalised parking). Secondly, even if CMS were successful in demonstrating that a contract existed between them and your Mum they could only pursue her for their reasonable losses. Let me guess, this was a free car park? Thirdly, their losses as a result of your Mum's BB falling over are, therefore, precisely zero. She owes them nothing.

    Communicating with any private parking company has proven to be a complete waste of time and so the advice is to ignore their notice and all of the following letters she will receive from them and their debt collector friends. Debt collectors have as much power as my neighbour's gerbils to enforce a debt - and there actually has to be a debt for them to chase - all, ultimately they can do is to ask her to pay. Remember: your Mum owes CMS nothing.

    The letters can be quite intimidating but can safely be ignored. The only documents not to be ignored are genuine court papers (some private parking companies and debt collectors are known to send out fake papers) but as the statistics clearly demonstrate so few people are genuinely taken to court by these companies the chances of it being your Mum are less than her chances of winning the Lotto.

    Have a good read through the posts here and take a look through the stickies at the top of the forum where you can see the letters your Mum is likely to get. Make sure you watch the BBC Watchdog video too.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    And HO87 says can you forward the letters on to him as his neighbour's pet gerbils like using them as bedding? At least you can be grateful then that CMS have been of some benefit to someone.

    Don't bother reading them before you send them, it will just be "same old" rubbish.

    Ha ha it is £55 which increases to £90 in 14 days, but by 6 months it will have gone down to £0 as they realise they are not dealing with a mug, and disappear.

  • Hi, I went to home-base on riverside retail park with my son who is nearly 2 I went to have a look around at some garden plants as iv just moved house and in the middle of doing it up, on return to my car I noticed a yellow bag on my windscreen wondering why? I opened it to say "FINE" with reason to believe you have left the premises £90 fine if I pay within 14days it will be reduced to £55 . I was in the shop looking around so I have appealed. On there email reply they have said without proof receipts they unable to cancel the fine it has also gone past 14days to pay £55 now an I certainly am not going to pay a fine when I have done nothing wrong. I'm extremely worried about what will happen if I don't pay and also debt company's getting involved , any advice on what I can do ?? any1 had the same ??

    What is the name of the company that this invoice is from? If it is a private company then just ignore it if it is a ticket from the council or police then that's different.....
    If it's from a private company then nothing will happen apart from a few more letters coming in getting more threatening...check out the stickies on this forum..
    A PPC is not just for Christmas...with a few CCJ threats you should have enough toilet paper to last well into the new year.....

    My car (I wasn't using it at the time) got a ticket on the same car park. Like you I was worried at first but after some advice on here and lots of reading I returned the ticket to CMS with the words NOT WORTH THE PAPER IT'S WRITTEN ON scrawled across in red.

    I addressed it to their "Appeals Dept" just for my own amusement, as both they and I know that it doesn't exist.

    JoJo, this will be some half-baked private company as the Council and Police don't issue fines saying you have left the premises.

    Whatever company it is, YOU DO NOT OWE THEM ONE PENNY and you have no need to pay.

    Do not respond, do not contact them, ignore each and every piece of toilet paper you will be sent.

    This is pure and simply a SCAM and if you ignore it they WILL go away.

    Pathetic.

    What bunch of crooks issued it, as a matter of interest?
