I have never used this forum before so hope I have put this in the right place. Please advise me, my son took his girlfriend to Pizza Hut on Robin Park last Friday evening, when they returned to the car he had a CMS parking fine on his window. I have just rang to pay them and no answer so I came on teh internet to see if I could find out any more info when I came across this site. I have now told him not to pay but he is worried as it was 8.35 and the signs do say the Retail Park closes at 8-30, but it took him 5 mins to walk back to his car. He did not park in front of Pizza hut because they had been shopping earlier and walked to Pizza Hut. Does he have to pay he can't afford this fine never mind if it were to go up to £9O

The legal position is that the driver owes the landowner the actual financial losses incurred by the landowner as a result of the parking.
I'm guessing the car park was free. So they've suffered no financial losses.
And even if they had, the parking company cannot pursue anyone for it, it has to be the landowner.
In this case, you owe nothing to anyone.
Ignore the ticket, ignore the scary (but legally baseless) threatening letters, and eventually they will give up and go away.Je Suis Cecil.0 -
Hi all,
I'm renting an apartment in a complex, close to town, with a car park managed by cms. All of the apartments are privately owned by individual landlords or occupants. Each apartment comes with an allocated space and permit numbered to match the space. As my flat mate also drives I have been parking in nearby streets and moving my car every 2 hours as to avoid getting a ticket.I then noticed there was a space not being used in the car park so I started parking there, but today have received a ticket. I think it was from a council employed street warden and was in the usual yellow packet you'd get in town. Should I pay or ignore? Could this affect my credit rating? I know this sounds similar to previous queries but as the details are slightly different I thought I'd check.
