Great to find this site and thread.
I've started a petition against private car parking companies who issue threatening letters to people to recover inflated fines/penalties.
As a new user, I can't post a link to it. Please can a member of this forum go to change.org and search for 'Car Parking' - you'll find a petition called "Campaign against illegal practices by car parking companies and their debt collectors" by Rory Ridley-Duff
Please sign the petition and add the link to as many relevant websites as possible.
Based on the evidence you have provided, I'll update the petition to target more companies.

Any questions after that about IGNORING a PPC fake PCN, start your own thread by clicking on the new thread button at the top of that link...
...but please, please, pretty please! read the stickies first and watch the Watchdog video linked there. 'Ignore the fake PCN scam and scary letters' is what you will be told to do anyway even if you do start a new thread and TBH most people should not even be in doubt if they just read the info we have provided.
If you have a private PCN, whatever the circumstances, your case is NO DIFFERENT than any other new threads you see on that link.

Within the correspondence it states that you were not the driver at the time of the contravention.
As such, because we are members of the British Parking Association (BPA) we are required to invite you to declare that you either were the driver of the vehicle at the time the charge was issued or to disclose the identity of the driver at that time.
We feel obligated to mention that, under the Pre-Action Protocol of the Civil Procedural Rules, court action must only be viewed as a last resort. We are making all reasonable attempts to avoid this outcome.
However, it is worth noting that, if this matter does proceed to court, we will request that a Norwich Pharmacal Order [Norwich Pharmacal Co. v Customs and Excise Commissioners [1974]] be issued by the Court so that the correct driver details would have to be provided.
Many forums /sites advise people to ignore parking charges; with some advising people to send standard letters to deny liability for the charge notice.
It is not advisable to believe what you read on the forums as we do take people to court.
This was proven in Oldham County Court in November 2008 where an operator won a case where the keeper stated that they were not the driver and could not remember who was driving. The judge decided that on the balance of probability he was the driver and ruled against him.

We have also attached copies of photographs taken at the time of the contravention.
Within the correspondence harassment has also been referred to. As such, we feel obliged to point out that under S1(3)(c) of The Harassment Act 1997, a course of conduct that someone alleges to be harassment will not deemed so if the person who pursued it shows that in the particular circumstances the pursuit of the course of conduct was reasonable.
We feel that under the particular circumstances our course of action has been entirely reasonable. We have legitimately pursued recompense for a breach of the terms and conditions attached to our client’s site.
Furthermore, upon your own denial, we are now reasonably asking for the details of the driver of the vehicle on the date in question.
In order to resolve this matter as soon as possible we invite you to either pay the outstanding charge via the methods outlined below or to disclose the identity of the driver.
As a gesture of goodwill, we will place the account of £150.00 on hold for 14 days from the date of this correspondence to allow time for payment to be made or for our company to be provided with the driver details.
However, if we are not furnished with one of the above within 14 days, the matter will be passed on to our legal team for their consideration.

Just ignore!. Don't forget that the BPA is not a regulator like Ofcom . They are just a cosy members club for the parking "industry".What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -

I have received a notice of intended litigation, or should I say my daughter has, she is only 17 and none of this is her fault! Am I safe to ignore it? IWe sent a letter stating she wasn't driving and was under no legally duty to disclose who was. I pay for my parking permit at work, it just happened that my car went in for MOT so I took my daughters, not even thinking about my permit being in my car! No ticket was on the windscreen and the first we heard was a demand for payment from Roxburghe. The letter received today is from Graham White solicitors trying to charge extortionate costs!
From what I've read I am thinking its ok to ignore but could do with some reassurance please.

After the riots spilled over into Ilford, lets just say my job required me to be working all the hours under the sun, I overstayed in one of the town centre car parks and started receiving letters from Parking Eye, now Roxburghe and I presume soon Graham White Solicitors.
I wanted to share with you how Roxburghe have changed their letters to possibly become even more intimidating, in particular;
We are fully aware of anecdotal information being presented via the internet and on various websites and you may feel this guidance is worth following. We strongly urge you to speak to independent legal advice rather than rely on these opinions, and we would respectively suggest that you refer to the Civil Procedure Rules part 31*, and more specifically parts 31.16 and 31.17.0
