    Well known scare tactics. What they omit to mention is that "Civil Procedure Rules part 31*, and more specifically parts 31.16 and 31.17." does not apply to the Small Claims track.

    The sooner Roxburgh and "Graham White" are put out of business, the better.

    Google the wording you typed out, you will see how common your letter is! It's been quoted on here and on other forums, if you want to help others please pm Crabman (this thread starter) with a link to it - with personal details, dates, location and ref blanked out of course - so he can display it.

    If you need more help please start your own new thread, luksakura, this is only an info thread not for discussion.

    Hi,On Friday 19.08.2011 I received a Parking Charge Notice from CPS Midlands,I had a car on private car park,I went to the shop and when I come back I saw the Notice on my windscreen.From about 2 years I left my car on this car park and yesterday I received Notice.I need to pay 75£ up to seven days because after 7 days they will give me another 50£.Please help me what I can do now???I need to pay it?I have a receipt from shop-time 14.47 but the time of Notice is 14.35 becouse first I was in shop outside this car park.:( What I can do.Please help me.

  • For a Debt Collection company pursuing on behalf of a Parking Company...i used this and it worked, not heard anything for 6 months now. Combined with the other letter to the Parking Company.


    Letter 1 - Debt Collectors

    In response to your debt collection letter I am not paying this amount to your company as you are pursuing an unlawful debt from company. This matter needs to be referred back to company for them to consider legal action against the driver. Please do not contact me again with regard to this matter and any future contact from your company will be regarded as harassment.

    See below legislation:

    The Administration of Justice Act 1970.
    Section 40 of the act provides that a person commits an offence if, with the object of coercing another person to pay money claimed from the other as a debt due under contract, he or she:
    a) harasses the other with demands for payment which by their frequency, or the manner or occasion of their making, or any accompanying threat or publicity are calculated to subject him or his family or household to alarm, distress or humiliation;
    b) falsely represents, in relation to the money claimed, that criminal proceedings lie for failure to pay it;
    c) falsely represent themselves to be authorised in some official capacity to claim or enforce payment;
    d) utters a document falsely represented by him to have some official character or purporting to have some official character which he knows it has not.
    Paragraph (a) above does not apply to anything done by a person which is reasonable (and otherwise legal) for the purpose of :
    (1) of securing the discharge of an obligation due, or believed by him to be due, to himself or to persons for whom he acts, or protecting himself or them from future loss; or
    (2) of the enforcement of any liability by legal process.

    The Office of Fair Trading (OFT) guidelines are such that; You should freeze action if the debt is disputed and I have enclosed the letter I have sent to company.
