For a Debt Collection company pursuing on behalf of a Parking Company...i used this and it worked, not heard anything for 6 months now. Combined with the other letter to the Parking Company.

Dear Sir
Payment ref : *********
In response to your debt collection letter I am not paying this amount to your company as you are pursuing an unlawful debt from company. This matter needs to be referred back to company for them to consider legal action against the driver. Please do not contact me again with regard to this matter and any future contact from your company will be regarded as harassment.
See below legislation:
The Administration of Justice Act 1970.
Section 40 of the act provides that a person commits an offence if, with the object of coercing another person to pay money claimed from the other as a debt due under contract, he or she:
a) harasses the other with demands for payment which by their frequency, or the manner or occasion of their making, or any accompanying threat or publicity are calculated to subject him or his family or household to alarm, distress or humiliation;
b) falsely represents, in relation to the money claimed, that criminal proceedings lie for failure to pay it;
c) falsely represent themselves to be authorised in some official capacity to claim or enforce payment;
d) utters a document falsely represented by him to have some official character or purporting to have some official character which he knows it has not.
Paragraph (a) above does not apply to anything done by a person which is reasonable (and otherwise legal) for the purpose of :
(1) of securing the discharge of an obligation due, or believed by him to be due, to himself or to persons for whom he acts, or protecting himself or them from future loss; or
(2) of the enforcement of any liability by legal process.
The Office of Fair Trading (OFT) guidelines are such that; You should freeze action if the debt is disputed and I have enclosed the letter I have sent to company.

In response to your ‘FINAL NOTICE’ that states that I was the driver of registration of vehicle, I cannot see any supporting evidence for your case to substantiate this. In Contract Law I am not obligated to inform you who the driver was at the time, so please do not contact me again with regard to this matter.

I have received the following letter from Roxburghe:
Simply ignoring it implies additional action by them including possible legal action for recovery of any alleged debt. By ignoring the issue they could effectively get a court order and a CCJ.
Any suggestions what can be done?
Just ignore these clowns. They still don't have the identity of the driver, just a picture of a unnamed person.

I have recieved a parking fine through excel parking about 3-4 weeks ago now, I didnt pay as I read online that its unenforcable.
I have now recieved a letter listed above, 'notice to the owner' asking me to pay £100 or it may go to court.
Im now scared of them gettin debt collectors and it affecting my debt record and credit ratings. I live with parents and dont want them collecting stuff from the house as its not mine for them to take.
Please will someone adise me what to do, is it best to pay? ignore or reply?

Re the APCOA notice ..needs redacting, although the name address and VRN are blanked the contravention code date and time will enable it to be easily identified by the PPC...it may be that the person supplying the document does not care ..but then again they might !0 -
