  • Smile or CO OP - are charging me £5 a day for every day I am overdrawn - in addition to a £20 charge. Worst thing is - I only got overdrawn because they increased the subscripion ....they reckoned they sent me an email telling me this (i never received it)

    Surley if you are charging someone £5 a day - the communication should be by recorded delivery anyway.....not email !

    A note to Martin, please -
    I am in CAG, too, but notice you emphasise it is preferable to make a Moneyclaim online. Unfortunately, this option is not available to those on Benefit, who claim exemption from fees via Form EX160. This was part of what I lodged with my claim in County Court yesterday. Proof of entitlement is required i.e. a headed letter of recent date, which confirms receipt of certain benefit and was the hardest thing to obtain. It did not arrive as promised over two weeks, 5 phone calls, and 2 visits to a local office.
    It appears that systems changed less than a month ago and local Offices are no longer permitted to issue them. Only because of 'proven multiple !!!!-up'(their term)was one written exceptionally by the In-house Manager. But that took another 2 days and second journey to collect.

    Another 'may be useful' - Court Officer explained that anything lodged on a Friday, may also be deemed served on the Saturday or Sunday's dates,if this is when your LBA 14 days expire.
    e.g. expiry Crimbo Eve? therefore had papers in yesterday.

    i am sure this as been asked before...

    I have received an offer in full and final settlement from If.com for one claim amounting to in excess of £1300 they have offered £533. Which i am going to clearly decline. Is there a letter template anywhere for this?
  • I claimed 1,210 from HSBC and they paid out 1,030. I sent out the initial letter reclaiming the charges and then the letter before action, at which point they wrote offering a settlement of 1,030. I accepted because I live in Scotland and you can only claim a maximun of 750 in the Sherrif Court, and although multiple claims are possible, it looked extremly time consuming and daunting. Not sure if it's the same in England, but it appeared from the court forms that one had to make the case for every single charge made. Again, not impossible, but daunting and worth the 170 odd quid.
  • I have just received my 6 years of statements from my bank (first direct - they also returned my £10 cheque) but am not sure about what exactly I can claim for.... Obviously not the Debit Interest, but can I claim for the Overdraft Fee, the Excess Overdraft Fee or both??

    Try something along these lines.....................

    I'm afraid I cannot accept your offer of £533. I will accept this only as a part payment and without prejudice, but I will continue my claim for the balance.
    I have just received my 6 years of statements from my bank (first direct - they also returned my £10 cheque) but am not sure about what exactly I can claim for....

    Amount they paid: £279[/B]

    The story: These charges snowballed within less than a week.
    Therefore I visited the bank in person - no luck.
    I wrote letter 1 - Reclaiming the full amount.
    They wrote back - saying they'd offer me £120.
    I wrote letter 2 - declining their offer and reiterating the amount I wanted back.
    They wrote back - saying NO.
    I wrote letter 3 - giving them 7 days to pay up or I was taking them to court.
    They ignored my letter for over 2 weeks.
    By this time I was all set to issue a moneyclaim but received a letter yesterday saying they would refund me the full amount as a 'goodwill gesture'.
