Absolutely fantastic, this really can work! I was charged £90 for 3 failed direct debits in 2004 and all A&L had to do was post me 2 letters. I downloaded the first template from MSE and received a quick but firm response that they were well within their rights to charge me. I then sent them the 2nd template threatening small claims action and again received a quick response stating that the law I am referring to only applies to credit cards, not current accounts. However I perservered and began court action online through moneyclaim which cost me £30 upfront. Within a week I have received a letter from A&L's solicitors stating that they feel it is unfair of me to ask for everything back plus interest as they are entitled to charge me something at least for their troubles but as they don't wish it to go to court, have attached a cheque for the total amount i requested plus costs! HOWEVER....THEY DO STATE THAT THEIR CLIENT (ALLIANCE & LEICESTER) SHALL BE CONTACTING ME SHORTLY TO DISCUSS THE FUTURE OF MY ACCOUNT AS I DO NOT AGREE TO COMPLY WITH THEIR TERMS. I can live with this though and have never been overdrawn before or after this so it will be their loss again not to keep me as a customer. Thanks Martin xxx:T0

I finally got a cheque for the full amount - But it wasn't as straight forward as some other people have found it - i first sent off the letter and was offered £1400 which i refused - i then filed the claim through moneyclaim website and Natwest Solicitors entered a defence on the basis that my claim was unclear, the judge had actually agreed and gave me 14 days to amend my claim or it would be struck out, fortunately in the meantime RBS had issued me a cheque for the full amount - but i note that one of the conditions was that i do not disclaim to any third party any details of the refund.. (oops!) they were adament in their letter my claim would fail in court but that since their legal costs would outweigh the value of the claim it was in their interests to settle! (yeah right!)
One thing i would advise anyone who is filing a claim is to make sure you put your account details, a list of all the charges and the law detailing why you think the charges are unfair. the main laws are;
Since the charges imposed are disproportionate to the costs incurred by the bank - such charges are penalties under common law - Penalties are illegal
Since the charges were in excess of the amount incurred this is contrary to the provisions of the Unfair terms in Consumer Contract Regulations 1999.
The charges are also contrary to the provisions of the Unfair Contract Terms Act 1977.
If you include all this in your initial letter it will let the bank know how aware you are of the law, and hopefully should speed up payment. My first letter was sent on September 27th and i received the cheque on December 18th.
I was lucky that i have a good friend who's a solicitor, if not for him and the information on this site i would have given up before now. BUT DONT! YOU WILL GET THE MONEY IN THE END!0 -

Wrote a letter asking for my charges back, and got a refusal.
Wrote back, threatening court. They have replied offering a gesture of good will of half the amount with no liability whatsoever. It's a new account with them (think I'd get better at this wouldn't you?), so I've decided to not keep fighting for the extra.
Quite pleased with this anyway...Claiming against Nationwide £2500Others to come!0 -

Just got a result from the RBS, £106, I've tried to be careful and not go overdrawn, aint easy with DD's and delay's with cash being paid in and showing on the account. OK it's not a lot but it's better than a poke in the eye with a blunt instrument. I didn't even have to fill out the Court forms.

The Story: Sent letter, they sent standard reply, sent second letter, another standard reply. Put in claim on small claims court, they acknowledged, and on the last but one day sent me a letter. Simplified response is, we (IF) are right to have charged you £180 but it would be too costly for us to take to the matter to court so here have the money plus interest and your court fee.0 -
i reclaimed £155 from Halifax on 19th November and got offered £127 this morning. Now, my question is ...of the £155 i claimed, £28 of this is not due to be taken until the end of december, so would one presume that the £127 is the £155 less the £27?i am happy enough to accept their offer, but should i say i am accepting it based on the assumption that the £28 charge will not come out at end of december? or do u think this will come out anyway??what do you think?thanks0
