  • Hi everyone reclaiming bank charges.

    Bank - Bank of Scotland
    Amount reclaimed - Over £5500
    Amount paid - Over £5500

    Started this claim about six months ago.
    Went through all the stages, first letter for statements, second letter asking for money back, third letter threatening coart action.

    Got court date and got claim served on bank but they did not turn up or lodge a defense, the court gave them 14 days to appeal, no appeal lodged so I won by default judgement.

    Had to phone the bank when they did not meet the deadline for payment into my account, maybe should have charged them for late payment for a change.

    Full amount put into my account within two days.

    Thank you to everyone on this website who supplied help and advice, it was very much appreciated.

    The only problem was that it was a large amount of money so it had to be split into smaller claims and it was in Scotland, but I got there eventually.

    Good luck to anyone still in the process of claiming and don't give up, you will win.

    Sent off my letters - took a few weeks. They said they were looking into it - sent off letter expressing intention to take to court - just before deadline received letter stating that as a "gesture of goodwill" they would refund £100 including charges yet to be taken...........they had sneakily taken some interest out of my account weeks after I had left it in credit and had not thought to tell me - this put me overdrawn and they just kept piling on £20 charges. Back to square one. Sent off letter - they have just replied saying that they have been more than fair yada yada etc.. I am not having it - they have written to me every 5 minutes over the last few months offering me loans etc , why could they not have just pointed out that I had gone overdrawn ? Have just sent off letter giving them 14 days before I start court proceedings.

    Amount claimed:£1,841.00 Including interest
    Amount paid out: £1961.00 Including interest and mcol £120 charge

    In all took 2 months to reclaim money.

    Sent both standard letters received offer of £473.00 I rejected this and asked for the full amount.

    16th April - Started my Mcol claim for the full amount.
    28th April - Capital one defended cliam.
    20th May - Received a "Goodwill Offer" of £1961.00
    27th May - Received Cheque for £1961.00 yipee

    Halifax bank - Amount reclaimed = £897.00 :rotfl:
    Halifax Credit Card - Mcol started April 18th won by default awaiting £1097.00
    Capital One - Amount reclaimed = £1961.00 :T

    Amount they paid: £1349

    After trying to treat our claim as a complaint, the bank acknowledged service of claim saying they would defend it (on the same day as the Berwick/LTSB ruling), then a week later paid up in full. An advisor on the phone said it's their policy at the moment to pay up, so I don't know why they didn't just do it before court costs were added - their loss!

    After 8 long months of being fobbed off I received a letter from their solicitors saying you are wrong in wanting them back and you have not won but here is your money.

    I'm yet to receive it in my account but they havent shut my account either

    ACCEPTED

    Phoned asking for copies of statements, was told it would take approx 6 weeks to produce them due to the volume they had to produce (isnt that a shame!!)

    Arrived 5wks later, sent off letter requesting by £1,100 back, received a reply within 2 weeks saying they would investigate my claim and get back to me within 8 weeks (apparently there rather busy at the moment with a LOT of claims)

    6 weeks letter, received a letter offering me £975 but not accepting liabilty, apparently it's a goodwill gesture, gladly accepted and money in my bank within 4 days!!

    Reclaimed £2166.OO plus interest. After waiting weeks for statements sent claim 6th May. Refused at first so sent letter threatening court action as per Martins advice. They put £1069 in bank last week whilst on hols and today when I rung to ask nicely for the rest I was within minutes offerred £2138.( I had added up charges incorrectly apparently - but I am not going to argue over £28!!)

    Have accepted

    Awaiting Halifax credit card and Barclays bank.

    Do not accept first refusal or part offer,
    Halifax were very pleasant to deal with on phone - honestly!!

    Hello, I'm a "Newbie" but have been reading the site for ages.

    Bank: Natwest Credit Card
    Amount Reclaimed: £736.00
    Amount they paid: £736.00

    The story:


    25th Feb - Wrote off for charges
    27th March - Received statements
    28th March - Sent 1st letter requesting refund of charges + interest
    9th April - Offer received of £228.96 (a "goodwill gesture")
    10th April - Sent letter rejecting offer, asked for full amount
    13th April - Same offer received of £228.96 ("final offer")
    16th April - Sent Letter Before Action
    20th April - Received letter saying last letter was their "final response"
    26th April - filed claim on MCOL (paid £80 costs)
    1st May - Natwest acknowledged claim intending to "dispute whole claim" - had until tomorrow to enter Defence
    26th May - received cheque for full amount, with a letter saying "it was not commercially viable or cost effective for the Bank to defend this claim".


    A BIG thank you to Martin and everyone on this thread/site for your help and support (even if you didn't know you were giving it!!) I reckon there are alot of people reading the threads and feeling very encouraged.

    I have a 2nd claim in for my Natwest bank account for £3,100 - they've entered their defence and I've just been transferred from MCOL to my local court, so fingers crossed on that one

    Hi there.Just thought i would drop in and say that i finally got success after all those letters, trips to the post office,telephone calls.

    Amount claimed:£2300 (including interest)
    Amount awarded: £1698
    Started claiming Feb 07.Got a letter offering amount last Saturday.I have signed it and sent it off (recorded delivery)back to Natwest.My family should be able to have a small holiday thanks to this.:T

    not a bad amount i'm sure you'll agree.Ironically, this will go towards paying off my overdraft.
    Want to say a BIG thanks to Martin and co for all their help and advice and to all those still worried about whether or not they are doing the right thing....
    Keep going no matter what.If i can do it,anyone can.
