Amex have just offered to settle my claim in full, i.e., Charges + Interest + Court Costs
I’ve been a Gold Card holder since 1999
The whole process played exactly to script, just a summary here, if you’ve spent time reading these forums you know the contents of these letters……
5th March – applied for copy of statements inc £10.00 cheque.
19th March – Statements received & £10.00 returned (goodwill gesture).
20th March – First letter requesting £436 plus £67 Interest.
21st March – Amex reply - Investigating complaint & will respond within 28 days.
27th March – Amex reply – charges are fair & reasonable etc etc etc.
29th March – Letter Before Action.
30th March – Amex acknowledged LBA, complaint escalated & will investigate further.
16th April – no response from Amex, claim issued through MCOL £80.00 costs.
18th April – Amex acknowledge claim & intend to defend.
1st May – Amex offer £366.43 (difference between pre and post 1st July 2006 charges £244.00, Interest £42.43 and Court Costs.)
6th May – Politely but firmly refused offer.
8th May – Telephone call from Amex, I was out so couldn’t call back.
9th May – Letter offering full refund £436 + £67 Interest and £80 Court Costs, usual BS, no admission of liability, charges are fair, avoiding unnecessary use of court time and legal expense.
Easiest £500 I’ve ever made, stick to the process and timetable set out on this and many other websites & wait for the money to come in.

Hi Martin and all interested parties,
My Wife and I have successfully reclaimed all our bank charges plus interest for the past six years. We achieved this by simply following your instructions and using your sample letters (on this site) as guide lines.
We got as far as starting court proceedings, with 8 days to go to defend the claim our bank (Halifax Plc) reimbersed into our account the full amount (£2474.87 incl. interest) we claimed.
Without admission, they said to defend the claim would cost them money of which they were unlikely to recover (even if they win) also because the claim would probably be allocated to the small claims track, in which costs are not generally awarded.
My Wife and I would like to say a big THANK YOU to a wonderful site.

Lloyds reponded to my initial template letter and refused to pay. I then followedd be up with the second and threatened to tae it to court and they failed to reply.
I filed a claim online and had to pay £50 to do so. The day that they were served with the notice they sent a letter and repaid in full with interest.
Be persistant!

I sent the first template letter, got a response to say they were investigating then a letter a week later saying that they have credited my account £300 although they disagree with my suggestion of over-charging and they do-not accept liability.

Story - prelim letter 17/3/07
LBA - 5/4/07
Filed MCOL 4/5/07 - not yet acknowledged
Received 2 letters:
26/4/07 - holding letter - will reply by 10/5
Today letter dated 10/5 offering £345 as a good will gesture - this was the amount of my original claim - but I have incurred another charge of £30 in the meantime and so I added this on to the figure claimed at court. They offered the £375 + refund of the court fee - I did not stick out for the interest, as, on this one it is so small (£31.86).
Amount will be credited to my account - but I could have had a cheque if I had wanted. I am happy to credit this to the account as this has an overdrawn balance on it, which I am gradually clearing and this amount will help me with that.
Will keep court claim going till the money credited - £50 to be credited today and the other £375 on receipt of my acceptance form. They also allowed me to amend the accetance form, as it said I accepted the payment for all my HBOS accounts - and I pointed out that I had another claim ongoing for another account.
Have now reclaimed £820 in total on 3 claims!!

I GOT MY CHEQUE THROUGH 2 DAYS AGO FOR THE FULL AMOUNT AFTER COBBETTS SENT ME THE BANKS DEFENCE AND THE REQUEST FOR MORE INFO WHICH WAS A LITTLE SCARY. MY COURT DATE WAS SET FOR 31/07/07. WAS A COMLETE SHOCK TO GET A CHEQUE THROUGH THE POST. I STILL GET TO KEEP ALL OF MY ACCOUNT FACILITIES WHICH I DIDN'T EXPECT. RBS SAID THEY BELIEVED THAT THEY WOULD WIN IN COURT BUT DIDN'T WANT TO RACK UP THE LEGAL EXPENSES AND THE CARGES WILL STILL BE APPLIED TO MY ACCOUNT IN THE FUTURE! IF I DON'T LIKE IT I SHOULD BANK ELSEWHERE.

Took a long time but won in the end. Initially requested statements in Nov 2006, eventually received a letter from their solicitors yesterday offering full amount!!!.
Now just waiting on my husbands claim with Lloyds, filed at the same time so fingers crossed.0 -

Wrote first letter, heard nothing, wrote again asking them to address charges,
heard nothing, just about to send 'legal' and received long blurby letter with guide to charges etc, feared usual stalling except top of page 2 they agreed to repay full amount as gesture of goodwill.
This is a sole trader account.
