Would like to say more but one of the conditions was not saying anything to a third party. Not defending because court costs would be greater tna they owed - just think they must have really expensive solicitors as court had allocated 15 minutes.

HSBC took 8 weeks to offer me £760 in settlement. I will accept this.
In total this took me about 2.5 months, 3 letters and 1 phone call - EASY! Very happy! :cool:

Started this way back on the 22nd Feb
Asked for statements and sent cheque for £10, called them after 2 weeks and they said that they knew nothing about it and that they could not be help responsible for the postal service.
Anyway within a week or so i got the statements and a list of charges.
Turned out to be about £1200 ish plus £300 interest charges.
Sent the usual template they came back with 1st offer of £800
I rung them up and said "TADA" the lady said to me "well how much do you want?"
All of it i said £1200 plus interest - she then said we will put a new offer in the post, but that it was not within their power to award interest.
2 day later got letter for £1200, maybe i'm greedy but i refused.
Took them to court £120
Started April 11th
Served April 16th
They Acknowledged and said they would defend April 19th
Still not received any letters or notification, but just checked my account.
Full amount has been refunded

PS One small blip - during this process i wasnt using this account and the !!!!!!s have charged me £100 on charges which came off my total.

The story: The refushed after the first letter. The second letter threaten them with court but offered to accept 75%, they settled in full.0 -

I wrote, asking for full refund. I was offered 50% over the phone straight away, but I declined.
The second letter was met with a "please call us to help us resolve your complaint" letter, so I rang up and was offered around 60-70%. I said I'd consider it, then rang back to be offered 80%.
A third phone call, including phrases such as "I'm prepared to take it to court," and "I feel I ought to take it to court and claim the full amount plus 8% interest, because I believe the charges to be unfair" yielded an offer of a full refund.
Bear in mind that the people you call will be dealing with this sort of complaint on a frequent basis, and they will know exactly how much they'll be authorised to offer. As the legal precident hasn't yet been set, they aren't legally obliged to offer the full amount, and you'll hear terms like "goodwill gesture" quite a lot.
A lot of customers will be angry and swear a lot - this will not help their case one jot! I found that by being pleasant, friendly, polite and calm; realising that my issue is not with the operator, but with the bank (it doesn't hurt to relay this to the person you're talking to); I could simply ask for them to increase the offer to the full amount. They didn't yield straight away, but with a bit of gentle pressure and a pleasant attitude, I got what I wanted without having to take it to court.
The concept of being nice to get what you want extends to loads of other situations - give it a try, you'll be pleased with the results!
Edit: Having read through a few other stories, I'd say to any claimers-to-be, "Don't accept anything less than the full amount without trying for the full amount". Ring back and ask for more. Another person may be authorised to offer you the full amount, and it's always worth asking for more than they offer.0 -

The story:
I wrote my initial letter on 2nd March and heard nothing until I emailed them on 13th March, when they sent me an acknowledgement. I then followed this with a telephone call every week trying to find out what was happening. I gave them a snotty phone call in the last week of April and within 7 days i had an offer of nearly £100 more than i asked for (which was very honest of them because i hadn't looked at all my charges for the last 6 years):A ! However, in the mean time they did charge me again but they included that in the money they gave back.
My advice would be, keep calling - they'll get bored of you soon enough!

The story: Used online banking to find and list all charges. Wrote to bank asking for charges back. Received a letter saying they were investigating. A few days letter received the standard 'get lost' letter, claiming the charges are service fees and therefore justified. Sent second letter giving 14 days or court action. After 14 days started MCOL. Received letter 10 days later from Lloyds TSB offering £750 'goodwill gesture'. Meanwhile Lloyds acknowledged the MCOL case. £750 was paid into my account this afternoon.
