    :o:p The story: I wrote the letter asking for the money. I recieved a letter within 3 days to let me know that they were considreing my claim. I then recieved a 2 page letter after 10 days. The 1st page babbled on about service costs etc and then it said "as a gesture of goodwill" they would refund the full amount claimed - yipeee:T !!!!!!

    did all template letters but nationwide refused claim went thru mcol after 28 days informed nationwide defending claim & going to court & added interest.

    day after recieved full amount in my bank account and letter telling me if i incur charges in future my account will be closed.

    without this site i might have given up glad i didnt ,now im going after the abbey & ready for action:mad:

    1st letter, 14.3.07:- Tried to claim £292 in charges.
    Natwest offered £88, 19.3.07, which was all the charges dropped down to £12.
    Accepted £88.
    Natwest Current Plus Personal Account.
    1st letter, 26.2.07:- Tried to claim £118.83 in charges.
    no response. sent 2nd letter, 15.3.07 threatening court action. no response. applied to Moneyclaim on line 30.3.07 and paid £30 admin fee.
    Natwest offered £103, 28.3.07 (the offer came in post AFTER i applied to moneyclaim online!!! argh! damnit).
    Accepted £103.
    Natwest Current Plus Joint Account.
    1st letter, 26.2.07:- Tried to claim £578 in charges.
    no response. sent 2nd letter, 15.3.07 threatening court action. no response.
    applied to moneyclaim online 30.3.07 and paid £80 admin fee.
    Natwest offered £485.35, 28.3.07 (the offer came in post AFTER i applied to moneyclaim online!!! argh! damnit).
    Accepted £485.35.

    1st letter, 26.2.07:- Tried to claim £3070 in charges.
    no response. sent 2nd letter, 15.3.07 threatening court action. no response.
    Natwest offered £2557, 28.3.07.
    Accepted £2557.
    i desperately wanted to take Natwest all the way through the courts to get the full amount of charges back plus interest and the moneyclaim online admin fees, but my boyf refused to take the risk of Natwest closing our accounts after the court battle(as he has a bad credit rating and it would have been very difficult to find another bank to take him on with similar banking benefits - yes we tried a few). So i had to fold after they offered us a part deal.

    I have to look on the bright side, we are now £3123.35 up!!!!!!!!! which is the cash back minus the £110 i paid to moneyclaim online.

    so happy. : )

    Two letters the second with the threat of going to small claims in 14 days if money not returned. They agreed to give all the money to me as a "GOOD WILL GESTURE" (hahahaha). Oh it take them 29 days to put the money in my account.

    Sorry I forgot to say I was claiming £467.12 this was all teh charges but no intrest.

    Those lovely people at Capital one have paid up! All my own fault of course but they dont wish to waste anymore of the courts valuable time!

    Firstly a huge thank you to MSE and all members

    Here is our story

    1st Letter - 30th Jan 2007
    2nd Letter - 3rd of March 2007 Requesting all my charges be refunded
    3rd Letter - 17th of March 2007 - Polite reminder or I will take court action

    Ok so thats the date's we sent the letter that we printed from MSE, We got a letter on the 20th of March saying they had 8weeks to investigate, We decided to allow them there time and that way we did not have to go to court. Called them last week the 17th to ask what was happening. Told they had until the 3rd of May 2007 to reply. Ok we thought!

    Today get a letter offering £1620 as a gesture of good will, We where furious that they thought for one second we would accept that stupid amount. I called them on 0845 124 1330 - Spoken with a member of staff called "Tracey" she was lovley and I explained that I was not willing to accept that amount, She offered me £2000 I refused and said I will accept £2500 as a final payment, Popped on hold for 3mins whilst she spoken to her supervisor. She then offered me £2500 as a final payment. I accepted. She than said, HBOS still not feel there charges are unfair, however we value your custom here. Money will be in our account within 5 days.

    Oh the account we claimed was closed 16mths ago

    End of story

    Oh we are off to curry's now

  • Yippee - I'm in the money!!!!!!

    Checked balances this morning to see if my promised bank charges of £694 had gone in but they hadn't, plus the a/c had gone over its £1k limit by £8. My bank is a 78-mile round trip so didn't relish the petrol costs. I rang Bank Charges Department to see if they could do an IBP (Inter Branch Payment - helps being ex-staff so I can whip them with the jargon!) who said that all the applications are done in order and wasn't able to help - I was extremely polite to her and said I can fully understand how busy they must be, explained my overdrawn situation and thanked her for her help. I then rang my Branch to see if they could increase my OD by £10 and explained I was awaiting £694 any day now. The lovely Clerk said "It's in Lisa!". I am so chuffed.

    My message to everyone out this is be patient and be polite and make a friend out of the person on the phone - they are only doing their job. By trying to understand their position (in other words, empathising) I achieved my goal and didn't rattle someone else's probably already frazzled nerves.

    Thanks for all the posts and advice Martin, much appreciated. Started the claim November, rather than use the courts i used the Financial Ombudsman and have recieved a letter yesterday saying the bank have agreed to pay. :D
