  • Hi, I'd just like to thank Martin for his advice as it has paid off.
    I had banked with HSBC for 10 years and had estimated they have charged me £1,000 in the last 2 years. I follwed the instructions on this website and sent them 2 letters they have now made me an offer of £816 out of court settlement this has only taken 30 days!!!
    I am over the moon.

    amount received 1782.70 (this includes 300 of charges since i started)

    sent off first letter in Feb with a list of charges up till October 06 received standard 8 weeks letter sent next letter pay me or i am going to court. On the day due to go to next stage filling in the claim on line i decided to ring HSBC as there was only 2 weeks to go till their 8 week deadline was up. Nice gentlemen told me to wait till the 8 weeks were up as i would receive their offer by then, rang again on the 8 week due date to be told an offer had gone out to me the previous day. The offer was 1582.70 including 100 charges accrued to date 16 April, this figure was in fact 300 but they wernt offering to pay the interest i had put on top. Rang them today nice lady told me they would pay me the 200 difference to 16 april but if i wanted the interest i would have to go to court. So i am accepting that offer. Thanks for all the info on here. Also HSBC customer services take for ever to get through but worth the wait very helpful and informative.
  • I know this is small potatoes, but just phoned Barclays to get mortgage refund overpayment back as in Martins article and will get £45 plus interest back in 5 working days!
    Off to reclaim bank charges now!

    WOW! Followed the instructions exactly Most important for me was to split my claim in to 2 so each was under the £5k limit (including the interest). AND do it to your timescale not theirs. I followed this advice and so got all the interest as well, as they did not respond fast enough to the court paperwork. They did phone to settle one but I had already gone to court!
    They paid out on one and left the other which they settled on the default judgement.

    The story: Started this in february. Got money end April 07. Well, ggt my statements, wrote the first letter to demand they repay charges. They sent me a letter saying they were investigating. I sent a second letter to say if they did not pay i will start a small claims. I was claiming without interest by the way. I also referred it to the Ombudsmen who also wrote to them saying I had a complaint. Then got a letter saying they didnt agree they were in the wrong and if it had gone to court they would win. however, as a goodwill gesture as they didnt want there name in court, they would pay me £672.00!!! I had to sign an acceptance form. money goes in tommorow!!!! Very pleased. It didnt take much doing!
    I am currently chasing up abbey, who are proving to be difficult as they wont even send me the bank statements despite taking £10 from my account. Been waiting since 22nd February. I have got the Financial Ombudsmen involved. Just going to do the second letter threatening to start a small claims. I know this is for at least £700 charges as well.
    Also waiting to hear from Halifax. I started this in 22nd February 2007 as well.... I have so far got a letter from them saying I will get a response for no later than 10th May. That is for £850 worth of charges. Fingers crossed ! One down, two to go. I will get my money back,,,, you mark my words!!!!

    Sent a letter asking for the charges plus interest back , got a reply offering £423

    (CAUTION: It is cleverly worded , as to make you think a letter is OK to refuse their offer , THERE IS A PHONE NUMBER TO CALL ON THE LETTER AS WELL , USE THAT):eek:

    If you don't call and complain they will pay in your offered sum and consider it settled.

    We rang them said 'NO CHANCE MATE' , they asked would we settle for all charges WITHOUT the interest , as we were short of cash at the time we agreed , but i think they would have gone the whole hog if pushed.:D

    22nd Feb - Used online statements to build schedule of charges
    Sent 1st letter no reply

    8th Mar - Sent 2nd letter threatning court action as had recieved no reply

    9th Mar - recieved reply from Colin saying the format was incorrect
    10th Mar - recieved reply now being investigated

    22nd Mar - Called charges team on 0845 6028006 waited half an hour they explained "FSA give them 8 weeks to reply to complaint" So i put the 8 week date in my diary and held off court proceedings

    19th Apr - Offer letter arrived
    23rd Apr - Sent response to offer by recorded post, which has been recieved by HSBC today, just waiting the 7 days for the money to go into my account.

    HAPPY DAYS thankyou Martin and everyone that has contributed to these boards.
  • This was easier than taking candy off a baby!

    day 1: wrote to bank requesting refund of charges within 14 days - no reply
    day 15: filed claim at MCOL
    day 20: claim served - no response from bank
    day 34: requested default judgment
    day 46: still no response from bank so requested warrant
    day 50: offer to settle from head office - it omitted warrant fee so rejected
    day 52: revised offer to settle for amount due under warrant - accepted
    day 52: 20 minutes later money paid into my account!

    I recovered well in excess of £750 from Barclays.

    Lessons learned:

    1. send all correspondence to your branch - not to bank head office or a central mailing center - the banks are so inefficient the delays go in your favour!
    2. let the bank say it has 40 days - but stick to your own and MCOL timeline
    3. file for default judgment and execution warrant at earliest possible opportunity
    4. sit back and wait for them to offer the full sum due! - especially once a warrant has been issued!
  • I settled with HSBC in the end after booking my court.

    Sole Account - £650
    Joint Account - £760

    and my partner also settled with Barclays bank for £1300!
