    Have received £460.00 from the One Account (which was tied in with the morgage). Also claimed from Woolwich £926.00, they have offered us £717 which we are accepting as it is money we were not expecting. I love getting this money back but do feel slightly guilty as we had spent money perhaps we did not have, but the guilt is wiped away when I found out that it actually costs such a small amount to the banks compared to the charges they levy. Especially since we were charged £29.00 when the actual inroad into our overlimit was about £3.99.
    No Matter what you do there will be critics.

    The story: I wrote a polite letter asking for a list of any charges incurred. I was sent copies of all statements, about 130 pages!, at no cost. I listed all charges and any refunds received, on a spreadsheet, and returned it asking for a full refund of the outstanding amount. They sent a cheque within a few weeks. I will be thanking them for that but asking why I didn't get a full refund. I'll let you know if I get the rest back.
    Generally speaking it's been hassle free.

    WAS OFFERED £1329.09 WHICH IS BASICALLY THE TOTAL LESS THE INTEREST AND AS MY BLOOD PRESSURE WONT STAND GOING TO COURT I ACCEPTED AND ITS GONE IN MY ACCOUNT TODAY !
    EASY PROCESS FROM START TO FINISH THANKS TO THIS SITE
    AND I DO HAVE TO SAY HSBC HAVE ACTED VERY PROFESSIONALLY AND HAVE BEEN POLITE AND COURTEOUS AT ALL TIMES, I PERSONALLY HAVE NO COMPLAINTS WITH THE WAY I WAS DEALT WITH ( APART FROM THE FACT THEY TOOK MY MONEY IN THE FIRST PLACE !!!)

    Sent letter recorded delivery requesting return of calculated charges giving 14 days to respond - no reply.

    Initiated Court action using template information with revised updated interest added on 12.03.07.

    Action acknowledged by Nationwide on 14.03.07 stating intention to defend.

    Defence entered on last day of response period (28 days). (Pony defence one line entered - Charges taken in accordance with terms and conditions)

    Case transferred to local County Court

    Nationwide settled action and made deposit payments into account stating that account may be closed with 30 days notice if unauthourised usage continued. A further £63.50 in pending fees cancelled.

    An excellent result-thanks for the inspiration Martin and the team who run this superb informative site!

    Advice for prospective claimants - follow Martins advice and prepare the groundwork well, ie obtaining all the relevant charges from bank statements etc, follow procedure and dont feel tempted to refer the matter to one of the growing number of companies who will take a sizeable chunk of YOUR MONEY when you get paid out.

    Bring on Lloyds TSB for a similar amount - case almost at the court steps - full schedule about to be served on defence and court to prevent any further delay ploys - other scalps to follow!!!
  • Sent one letter asking for £640 plus int which came to a total of £902....gave them the benefit of doubt when i got the standard we are looking into this....rec letter dated 19th april on the 20th april stating that they dont admit liability but would be prepared to settle at £611.24 . They also refunded charges after the letter upto the 16th april.
    SO THANKS MARTIN I WOULDNT HAVE DONE THIS WITHOUT THIS SITE

    Wrote letter giving full details of charges on 7th Feb. Bank refunded full amount a couple of weeks ago. Of course, their letter said they would have won in court - but as a goodwill gesture etc.

    Partnership Card £24 =£24:rotfl: (They settled nicely on the phone)
    Total reclaimed including fees £1360.17Actual achieved £1600.17 with £95.48 outstanding. Some of them forgot that they had credited goodwill gestures and with the dash to settle with a court date looming they paid to much!!:j All thanks to me watching a T/V interview with Martin:beer: . Started Dec 06, 7 down 1 to go.
    The moral for other readers is 1) be tough I even went to mcol for £1.13 of interest. (They pay up) 2) stick to the time frames and don't bother trying to be polite with courtesy phone calls. I waisted hours this way and achieved nothing apart from frustration:mad: except 1 as above. If you get to a court date stage and need to prepare a bundle for court (I nearly did) Look on the CAG (Consumer action Group)site "Bookworm" has done all the work for you. (although I did not need to test it in court it looks excellent): THANKS MARTIN

    The bank wrote to me yesterday, saying that it would take too much money to come to court with me than the amount iam claiming, which is probably right but a lame excuse. They told me that because of that they will refund all of my charges "Without admitting they are unlawful" , haha.

    Just awaiting a response to my Capital One and Barclaycard now, My brother and father are also waiting on a defence to be filed from Natwest....

    Just want to say thanks to martin and all of the staff and members on here for the help thats been given.

    I started my claim against Barclays in Aug 2006. I used the template letters from from this site. I received initial letter telling me they would look into it. Eventually received letter offering me under half of what I was claiming for. Sent 2nd letter of rejection. Eventually I had to go through the Small Claims Court which was then forwarded on to my local court in Oct 2006. By Jan 2007 I still had not heard from the court so I phoned them and was informed that the court had lost all my paper work. I then had to complete the court forms once again. I eventually got a court date for 18th May 07. I was instructed by the courts to send all documentation I was presenting to my bank by the 13th April 07, in turn my bank should send me their documentation by the 20th April. Received a phone call from my bank today 20th April 07 offering a settlement. There seemed to be some confusion with the total amount what they were offering me which was sightly lower than what I had claimed for. I was asked by there bank where I had got my figures from which I told them was from the break down of charges they had sent me!. In total I am getting just under £2000 which includes 8% interest + court fees. A big thank you to everyone who has made a posting I have become a regular viewer, also to Martin as it gave me the courage to persue it to the end . It does seem like a really daunting process and I got really nervous persuing it through the courts but it paid off in the end. So anyone in the same position please do not be intimidated by the banks as it does eventually pay off.
