I received a letter dated the 7th February saying that they were dealing with my complaint and that I would hear from them regarding the claim within 4 weeks. Today (06-03-07) I received a letter saying that they apologise that I have not had a full response to my concerns but that they are still investigating and I will receive a response no later than the 3rd of April 2007.
So whats my next course of action? Can I send the court letter or does the fact that they have replied mean I have to wait? Is this a stalling tactic before the OFT report?
Any help would be great!

CAN ANYONE HELP PLEASE?I have claimed back my statements from BOS on the 24th January. Last week 3 years worth arrived and despite several phone calls to my local branch also to the number that was on the accompanying letter with the statements there is still no sign of the statements, I can only assume this is a delaying tactic possibly until the OFT statement in April, However I do have the last two years statements on my internet banking webpages, Would Iit be worth going through them all totalling the charges with the one year missing and including something on the bank charge claim letter that I still intend to claim for the missing period i.e. Apr04 till March05l I think ironically that this would be the period where most of my charges would be but I am concerned that if it is not done by April then I will receive less back

aslong as you've given them warnings about going to court then file the moneyclaim - they should back down then - halifax did for me this week (£4317 & £680) + you'll get your moneyclaim costs back too
Just to confirm: is this stuff about the 8 week's they are "entitled by the FSA" to wait a lie then? Just that I got the same response from Halifax through this morning (by phone).
It took me 3 1/2 months to get my statements from Halifax - they kept sending me the last two years but nothing prior to that. I finally got them through, after 11 separate requests, last week so I only sent my initial claim letter through on the 3rd March.
Should I still just give them 14 days (as stated in the letter) from that date to respond, then send the "I'll take you to court" letter?

I am on the final straight with Halifax so hopefully i can give you some guidance. In advance of going online to fill in the 3 or 4 lines of basic information with the small claims court, i applied and got an Alliance & Leicester online premier account.
I went into the branch and they filled out all the paper work there and then and you then sign and post it. They are a small bank so it takes less time to filter through. They offer a £650 interest free overdraft initially and that can increase to £2500 if you can produce a Halifax statement where you were in credit 2 days or more. I unfortunately couldnt provide that and am limited to £650.
Whilst that is in the pipe line you can fill in the details on either letter 1 or 2. The first is a polite request for your money back along with a list of unfair charges, etc. The second is a more assertive request with the threat of going to court over it within 7 days. I think that letter 2 is the first one to use as the clock is ticking until the office or Fair Trading issues its recommendation on what the banks SHOULD charge. This is expected early next month. This will give the banks a small excuse to not give ALL the money back and to keep some (expected to be £12). In effect you only get approx 66% back.
Sometimes Halifax will give all or some of the money back at the second letter, however, i am reading more and more on this forum that the banks are going right to the wire (maximum time allowed could be 35 calendar days, 28+7) which will probably be after the OFT's reccomendation, therefore giving them the excuse that they can charge, for eg, £12.
My point is this, get the second letter in (threat of court) asap and wait 7 days. This will rattle the tree and they should respond with an offer. If not then apply on line with the small claims court and set that ball rolling. If you get to that point then expect a 28 day wait until they decide to defend, then expect another 7 days (or more) where the evidence is consulted by the judge. Its looking more and more likely that the banks will have their alarm clocks set to go off 1 day before the judges decision and then they will give up and offer to settle outside of court. That way they get maximum time to achieve a 33% reduction in payout. (considerable when you consider that they have shelled out millions so far)

Further to my previous plea for help I have once again called The BOS number and have been told that they will send out the statements missing from Apr03 till present. This will take 10days!(we'll see) was told that when I applied for statements they go in an automated 4 week queue and therefore they can,t understand why they didn't all arrive, when asked if this was a stalling tactic I was told of course not! :mad:
Unfortunately until I have all the statements I won't be able to total my charges,but once I do and submit the claim letter Where do I send it? Is it to my own branch or Is there an address elsewhere?

Hi - I started claiming my bank charges last year when it all started and our bank offered us half and made us sign a letter agreeing to just half, which at the time was a great help but I have since read in newspapers and other articles that the banks should repay in full - does anyone know if there is anything we can do now even though we signed a letter agreeing to just half our bank charges back. We accepted £1,000 but the actual amount was about £2,600.0 -
