  • initially a sucess.....

won back £430 from alliance and leicester and promptly spent it then about 6 weeks later they wrote to me saying that as i clearly cant keep to theterms and conditions of my account they are giving me one months notice before closing it ....... and demanded i pay back my overdraft ouch!

the sting int he tail was that my overdraft was £450 so if i had held onto the money i won back from them for a few weeks longer i could of paid it back easy peasy! im now paying it back in instalments of £160!!!! double ouch!

my own fault but after the stress of bank charges i have to say it made me feel sooooo happy spending the money i won back from them but it was not to last!!!
  • Bank: 1st National Motor Finance (part of Abbey)

    How much: £ 66.27 (!)

How: Started claim in April, they would not pay up. Right to the last minute, their solicitors finally aid they would pay up, but wanted confidentiality (which, as anyone who's seen me on TMcD knows, was NOT going to happen!).
Ended up in court last week, other side didn't show up, and as they'd tried to enter defence too late, it was disregarded and we won, on penalties, as it were :D . The judge made it very clear that it was NOT setting a precedent, (obviously, as small claims!), but he did accept that the charge WAS a penalty!
  • First direct.
    charges £60
    refund £60

I have a £500 overdraft facility on one of my account, i went overdrawn on my overdraft by £6 for 1 day, & was charged £60, emailed them stating i was not happy about their charges, reminding them i have 2 accounts & a mortgage with them & it would be no problem to switch them to other banks, they payed up within 2 days. However they have charged me another overdrawn fee of £30 only thing is I'M IN CREDIT?!!! Oh well here we go again.

    Bank: HSBC
    Amount Claimed for: £949
Amount Refunded: £850 within 3 weeks of the first letter being sent

I know I'm advised to push for the whole lot, but I do think banks deserve to be refunded for what it's cost them to deal with my account (and believe me I've been terrible it at managing it myself) so I believe this is a fair split for having the account 5 years.. I paid it straight off my credit card. Incidentally, for anyone looking at claiming from Natwest, I've a friend who works in the complaints department for them, and he says they're paying up once they receive a summons. I also think if the law was on their side, they would have resisted this process by now.

    Bank: HSBC
    Amount Claimed: £798.00
    Amount Refunded: £700.00

Just received the above offer from HSBC and think I will accept! It's too much money to be gambling with if I decided to pursue to the Online Court stage! I really can't afford to lose that much and to be honest, at the moment, can't be doing with the hassle!!

I am quite amused how they offer just below what they owe!! It would hardly cost them the earth to give me back my £98.00 as well but hey, can't complain!!

If they managed to undercut everyones claim by £100 or so they could potentially stealthily save themselves several hundred thousand pounds, even millions, depending on how many people start to claim. Its clever beacause to them its pennies, but to you its a lot of money. So they bank on you taking the offer. They always pay out the full amount in the end. But of course if you're happy with it, which I can see you are (£700 would go down very nicely here too), then well done, and spend your winnings wisely!!

    The story:
Had my doubts to begin with but very happy with the end results. Mr M Lewis will certainly be getting a contribution towards his site.

Sent letters with 14+14 28 days total notice, had no reply after this period so rang up on the 31st day (Monday) and told the bank I was sitting at my PC ready to initiate my claim on Moneyclaim.com, after first saying "we have no details of any claim being made" they suddenly changed tack and replied "please wait a few days as we are looking into your claim".
    I waited
On the 36th day (Saturday morning) received a letter offering me 2.2K.

Only disappointment seems to be the inability to get statements going back more than 6years and therefore only being able to claim over a six year period, if i could have got hold of that data I would probably be even better off.

    Cheers Martin

If there’s any way I can help spread the word or help advise others on the process I am happy to, banks suck and the people should rise up against them for a fair system.

It is only possible to claim back 6 years, so dont worry, there wasnt anymore you could have claimed for.
