Nationwide will more than likely close both accounts so make sure he has another account now and close the accounts once the overdraft is paid then ask for a cheque when you send off the first letter asking for the charges.
and if you pay off the overdraft, make sure you get the money from his successful claim!
Thanks very much for the advice, I'll make sure we send off a cheque to them straight away. I expect I am being stupid, but, what do you mean when you say "...ask for a cheque when you send off the first letter asking for the charges."
By the way I will definitely get the money back from him somehow! They call me Mr Pig!0 -

Normally the banks will refund any claim into the accounts claimed from so what I suggest is by the time you get the statements and work out the claim you have both accounts closed so in that case make sure you ask for the reclaimed charges to be paid to you by cheque.0 -

Hi everyone, can anyone give me a bit of advice please? I have just filed mcol, and am not sure what the next step is. Do I have to send nat west anything else, or do mcol take it from here? I have been trying to get charges back from nat west since last December, no luck, filled in mcol paid my fee, but not sure what the next step is.
Thanks

Bank: Natwest
Amount claimed: £879
Amount won: £879
Only sent one letter and only took three weeks, they replied with the standard their in the right but as an offer a gesture of good will they will pay the 879 straight into my account if i sign to say i won't do it again! My overdraft of 750 has now been paid off 3 n half years since starting it! Littlewoods and Capial One are next on my hitlist! Good luck to anybody else thinking of doing it, it's well worth it!

What a godsend that I fell across this site one drunken night.
I'd seen loads of great money savers on here but was a bit sceptical, but what did I have to lose !
I wrote off to HSBC, just before the New Year.
Got a package back just after the new year with my statements for the last 6 years.
Went through and found £412.50 of charges. Sent the letter asking for my £412.50 plus interest, which worked out at something like £523.
I got a letter back saying they didn't find the request for interest acceptable, but for the time management and legal costs offered me the full £412.50!
It's a bit of a shame it took me so long to find this, as 6 years ago, I was almost 19, but when I had just turned 18, I was over my overdraft every week, it would have been alot more.
But I would like to say thanks very much to Money Saving Expert!
I have paid off my overdraft and just booked a nice weekend away for me and the missus with the extra!
Please add my refunds to your rolling charges
Total Requested with interest: £523
Total before interest: £412.50
Total regained: £412.50
Thanks again!
Top notch

Firstly your 'amount claimed' should not usually include any interest. That is up to the court to add on afterwards if you get that far. it is does include interest then don't worry about it - just be prepared to answer any questions about it.
Secondly, as to what happens next - the ball is in the bank's court. the claim is deemed to be served six days after the court posts it out. From then the bank has 14 days to either file a defence or acknowledge your claim. They will almost certainly do the latter, saying they intend to defend it. That will have the effect of extending the time to respond from 14 days to 28 days (from the original service date).
It is at this point that you should expect some contact from the bank - NatWest are good at getting their solicitors to send out complicated legal letters and there is advice elsewhere on how to deal with it.
If the bank makes you a decent offer you should seriously consider accepting it in my own opinion, but it's up to you.
In the unlikely event that the bank does not respond after either 14 or 28 days depending, you can apply for judgment in default, via the web site.
