Part of the Furniture Combo Breaker
Our problem is that we were aware we would be going over our overdraft limit by the end of the week, so last Monday we arranged for a further £1000 from our Direct Line mortgage to be paid into our Halifax account. They said it would be three days, and so as I was due to pay our Tesco credit card off arranged for £600 to be paid from our Halifax account to the Tesco credit card on the Wednesday and the remaining £400 would in effect pay off the overdraft with the Halifax too. We have an £800 overdraft.
Then disaster happened, the £1000 from Direct line did not go through on the correct day, which meant the Halifax have now issued us with a letter saying they are going to charge us for 3 £4 transactions and the £600 Tesco transaction. A total of 4 x £30 + a £28 unauthorised overdraft fee, which is a total of £148!
Because the £1000 did not go through it meant we were £1000 overdrawn - £200 over our limit.
Direct Line have apologised for this and said they would pay out for any charges the Halifax have charged us. They had a failure in the system and the £1000 will not be going to our bank until tomorrow (Monday).
What I am upset about is that we have a savings account with the Halifax too which if I had known before Thursday that we would be overdrawn I could have moved some money from to the current account. The Halifax never phoned us to let us know we were overdrawn - the first we knew was when we received a letter from them about the charges on the Friday. We then phoned Direct line to ask what was happening.
Direct line never phoned us or even thought for a minute that their system breakdown may put us (and perhaps quite a few people) overdrawn - we had to contact them.
We use online banking but certainly do not log on every day. What's with the lack of communication.
Also if Direct Line refuse to pay out for these charges after all, will we still be able to reclaim any charges through this usual way?

    Please can someone help?

    - MCOL claim entered on 29/01/07 for £432.13
    - Acknowledged on 31/01/07
    - On 07/02/07 £262.36 and £50.00 was refunded and I had a letter to that effect. Letter stated it could not refund any further as they had no other record of charges. After speaking to a member of the Northampton Service Centre, she said to send a breakdown. I told her, they already had a copy but sent another one recorded delivery which they recieved on 10/02/07.
    - On 13/02/07 £120 was put in to my account and shows as correction - the same as the other amount above. I have not recieved a letter to state what this is for. Do I assume this is another refund???

After the first refund, there was £169.77 outstanding. If I do assume the £120.00 is another refund it means there is only £49.77 outstanding.

Would you wait for Nationwide to get in touch or would you contact the bank to find out what the £120 is???

How do I inform MCOL that I have had some of it refunded? The 28 days are up at the end of the month, what happens then???

Oh, by the way I have had 2 letters from Nationwide saying they are closing my account - the letters have different dates on them.

Thanks in advance, sorry its a long post

    p.s. MCOL now states defence

I am claiming £2,000 from the Nat West, I am on the final hurdle, and have involved Moneyclaim to help, as I have had no response from the Bank. My query is, once I have filled out the forms and paid my fee to Moneyclaim, do I have to do anything else, ie. write to the bank? Or do I just leave it all up to Moneyclaim now? Can anyone help please?

    Thanks

    Bank: First Direct
    Amount Reclaimed: 598
    Amount Paid: 510.

Very Easy! Thank you so much Martin & Co. Didn't need to threaten court action. Tried for interest as well but First Direct "are not prepared to review a claim for any additional interest", so took their offer. Will now spend the money on a flight to somewhere hot!
Note- You don't need to include the £10 chq for the statements from First Direct, they do it for free...bless them!

I wrote to HSBC on 8 Feb using the template letter and the fantastic calculator to work out my charges. I sent the letter recorded delivery. I received in the post today a letter thanking me for my letter and saying that they would be looking into the matter. Is this a delay tactic? How long should i give them to "look into it" before I start my money claim online? My initial letter said I would give them 14 days to respond but now i have this letter from them, should I give them more time?

I received the same letter from the Nat West, telling me they were looking into it, and were sorry to hear I wasnt happy, that was back in December, and I am still waiting. My advice is give them 7/14 days as it says in your letter, then go for it. I kept saying, they will write next week, but they never do. Dont hang around, you wont hear from them. Jane

I sent my online moneyclaim yesterday and paid £50 but now I have just noticed that because I get working tax credit I am exempt from paying the fee. I know I will get it back from Barclays if I win so should I just wait for it back then or what?

Hi I am nearly at the court stage with Barclays and this would be great that I don't have to pay the court costs as I claim WFTC! Hee Hee :rotfl: :j :rotfl:

  • Hi

Sorry to post again but I am worried that it'll get lost and desperately need a reply! Thank you all in advance.

    Hi

I am with Lloyds - could I ask you a quick question? The 40 days are nearly up but I have not received my statements, should I phone the place I sent them to? And if so, is this usually enough? All the other letters are geared towards knowing how much the banks owe, but I haven't even been this successful yet!

I desperately need the money to pay off debts and am fast losing my nerve to go through with the letters and court threat! I know that there are so many people requesting help, but if someone could offer me a few linesof advice, I would be so grateful.

    Kind regards to all!
