    I now see it says MCOL say use an address in England. On my claim form i used the Barclays address that my correspondence had been coming from which was based in Swansea. As this is wales is it a problem or is it just that Scottish law is so different?

    Part of the details asks when the account was opened. It was soooooooooo long ago I can't remember. What answer do I give? Can I write 'over 6 years ago'? :confused:

    Please can someone advise because I have got this far and I am in the right frame of mind today to get this ball rolling.

    Please can someone advise because I have got this far and I am in the right frame of mind today to get this ball rolling.

    I have changed the wording slightly to suit you.................

    Edit the parts in bold to fit your claim.

    The Claimant has an account XXXXXXXX (put your account number) with the Defendant. Since (DATE XX/XX/XXXX) the Defendant debited charges and interest in respect of purported breaches of contract.Defendant is aware of all details as a list of charges has already been supplied. Claimant contends: The charges exceed the Defendant's losses caused by the breaches; The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. Claimant claims: return of the amounts debited of £XXXX; Interest per S.69 County Courts Act 1984 of 8% - £xxx [enter interest total at date of claim] continuing at 8% until judgment or settlement at a daily rate of £0.xx; Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. Costs allowed by the Court.

    BARCLAYS BANK PLC
    1 CHURCHILL PLACE
    LONDON
    E14 5HP

    If you contact the court, you can ask them how you ammend your claim to change the address.

    I see this question alot on here and sorry if this is not much help but if you phone your bank will they not just tell you? Its not as if its classified imformation. I'm sure they wont say we are not telling you cus you might be gonna take us to court!!

    Contact the court, and ask their advice. They are very helpful.

    I already had my 6 yrs worth of statements, sent first letter (template from this site) recorded delivery to my local Natwest branch, this got lost by Royal Mail but tracked down and delievered 10 days later, within 3 days I was sent a letter and also some leaflets on terms and conditions, on the second page the paragraph started with: However, on a gesture of goodwill we are offereing you today........ anyway I have accepted this paid my holiday, so THANKYOU to Martin for helping us all, I will raise my cocktail glass to you whilst lazing on the beach in Lanzarote.

    A simple email was sent via Internet banking highlighting the problem and outlining how I wished it to be resolved, with in 16 hours the full amount was refunded back into my account.

    Please remember that the person at the other end of the line is the same as you or I, and as such deserves to be treated as such. We have to respect the fact that they are just doing a job, ok we sometimes see them as the enemy but at the end of the day bills need to be paid. Don't get me wrong, I hate banks and other Financial institutions as much as the next person, but you would be surprised how much can archived just by being polite.

    SO, my next victims are
    HSBC - £4,900 (MCOL expires 05/03/07)
    Citicard - £350 (LBA expires 26/02/07)
    Clydesdale Financial Services - £628 (MCOL to be submitted in the next couple of days)
    Lloyds - £TBC - I'm going to try and claim charges for the period of 1991-1997. (SAR expires 05/03/07)
