    The story: Sent the first letter from this website, got a reply saying the charges are all above board, so I sent the second letter, received notification today that the bank are willing to pay the amount requrested as a goodwill gesture.

    Thank you Martin! This amount has now cleared my overdraft!!!

  • In 2002, when I was a student, I had a HSBC account with an agreed overdraft limit. I had to go home to my parents at some point as I was having a minor operation. During this time, a direct debit took me over my agreed limit and the bank sent a few letters to my student flat, detailing charges etc and asking me to put the money back in the account. By the time I returned home the bank, in reaction to my failure to put money in the account, wrote and told me that they were closing the account and demanded I repay my overdraft in full within the next 7 days. They threatened court action and baliffs if I didn't do this. I also had a credit card through the bank, and they also wrote demanding I pay it off straight away because of the situation with my account. I had never missed a payment on the card. Having little money, I rang the bank and they told me they would combine the debt and turn it into a loan, which I payed off with interest for several years. As this reaction to going over my overdraft now appears to have been 'unlawful', do I have any grounds to try and recover the interest that I paid on the loan that I was forced to take out?

    The story: It got to before the court stage letter and they have written to me saying as a gesture of goodwill they will refund on this occasion only blah, blah. yay!

  • No you can't claim back on the interest on loans as you agreed to the loan and the interest is worked out over the term of the loan.

    Wrote to them on 31/01/07 asking for statements....got a reply on 15/02/07 that not only included a breakdown of charges but an offer of settlement as well! Decided to settle as it was pretty close to the original amount.

    FYI.. After trying unsuccessfully to get thru to the dept dealing with lloyds TSB claims for three days, I eventually got thru. I have it from the horses mouth that Lloyds are taking these claims all the way ( but not defending obviously).Their logic is whilst they are paying the statutory interest and costs, they are in fact writing these amounts off against all the people that ask for refunds and subsequently give up!! I was also told that a ruling is expected from the OFT before the end of Feb and that I may be wasting the court fee? Whilst this was probably designed to put me off claiming online.....has anyone heard such rumours??

    Sorry I didnt explain very well. I wondered if people are contesting their banks decision to close their account once they are given the 30 day notice period? Or is there no point and they will just close it whether you fight to keep it or not?

  • I wrote to HSBC on 8 Feb using the template letter and the fantastic calculator to work out my charges. I sent the letter recorded delivery. I received in the post today a letter thanking me for my letter and saying that they would be looking into the matter. Is this a delay tactic? How long should i give them to "look into it" before I start my money claim online? My initial letter said I would give them 14 days to respond but now i have this letter from them, should I give them more time?

    Advice please! Started recaliming my bank charges
    using the advice letters etc from this site - was even brave enough to put it in court (would have given up when they said no twice without this site!) Nationwide have put the total amount claimed into my account without any communication just came up on my statement as refund of interest, but without any interest or the court fee I paid which was £120 - should I write to them and request the balance, notify the court, my initial feeling was I got £889 that I never expected back and so I should just be happy with that, but am now thinking I should ask for the rest which comes to almost £600

    Hi there,

    I had exactly the same letter from them. It just means your claim is going through the system and is a courtesy response.

    I had my money in my account about 3 days after that letter but each case is different.
