I have a similar problem to many others in this thread - this time with a CB from e2save (DUNSTABLE). They deny receiving it despite a) proof of delivery b) resending electronically within time limit [for which I have an personal acknowledgement from a CS rep via their online system]

I think a big problem is the internal communication between the depts & a level of incompetance in the management of cashback. Further contact via CS is a lost cause.

Has anyone found a person/email address at e2save that can help sort this before taking them through small claims court? I am as sure as I can be that I complied with the originally supplied T&Cs as part of contract (not the online mycashback ones).

My current plan is to contact Charles Dunstone's office (cpw)

    Any recommendations?

Read all the threads relating to E2Save/OSPS/Onestopphoneshop and my LBA guide on:-

I have given lots of (repeated) information and advice on all these issues for months on those.

My terms state clearly that I had to send the bill which showed I had been connected for 120 days. They rejected the bill I sent saying I should have sent the previous one, which arrived 106 days into my contract, because the airtime is paid in advance. I told them that was rubbish, as that is not what it says in the terms.

My contract stated airtime bill 3, my online account said Aug bill before it was altered (so these both matched the Aug bill)
Unlike Mobilejunkie I don't believe the T&Cs count for so much, in UK law contracts have to be reasonable. Where a customer is given several conflicting sets of information, courts will usually rule that complying with ANY of them is correct.

I also think altering my online account details will count against them ..... "perverting the course of justice"

But I can understand E2Saves POV, they are out to make money. If they refuse cashback on 12 accounts and 10 of the accounts recover through the small claims, they have made a small profit. If only 1 out of 12 uses the court that will mean about £4000 extra profit.

10 out of 12. What about the legal fee's (solicitor's aren't cheap), and the time, and bad press they'd get? Not to mention losing future customers. All costly. I can see you're point but I think you'd have to lower 10 quite a bit.

  • The only legal fees are small claims which is about 1/12 of the claim
Nobody is likely to use solicitors.
You assume they care about future customers or bad press?

  • just thought I would mention, i took out TWO line rentals 26th May (NOT PRICEMATCH).

Touch wood, i recieved the first and second cheques roughly three weeks after sending bills in.

initially had problems with first claims because all information indicated i send in OCT Bill, as it stated the 6th month bill. however day of sending out, i called up to confirm and they stated it was 6th bill (november) instead. Sent it in with a letter that stated name and ext number of informant. and got the cheque within three weeks

Did the same with Bill 8 (Jan 3rd), called up to confirm its still Jan (got name and ext) and provided this information in accompanying letter - got the cheque on 28th.

hopefully be as simple for claim in 10th (March) and 12th (May) bills.

PLEASE NOTE THIS WAS NOT A PRICEMATCH OFFER AND THEY DONT DO IT BY DAYS.

e2save does have some good days i guess. good luck all

I meant expense for them. Of course they use solicitors. I've got a letter from solicitors on their behalf. I'm due to go to court sometime in the next 4 months. They will have a solicitor present as representation. Just that and writing any letters will be costing them hundreds.

    I've been Money Tipped!
Second cashback received from e2save within 2 1/2 weeks from being sent.

Interesting to see the issues, good luck to all concerned.
I simply went along with what they wanted and all seem fine, excellent service and by far the best to date.
Personally, I think the e2save staff don't/didn't fully understand the "borrowed T&C's" and it has made things confusing.
The new T&C's seem a bit better with an automatic first cashback, hope this goes just as smooth.

Ive got a question about e2save:

I sent my first e2save cashback request on 14th January, and I haven't heard a response from e2save yet. The period where I needed to send my bill was on 10th January - 9th February according to mycashbackclaim.co.uk (which does appear to be 120 days after connection). Should I be contacting e2save now to check if my cashback request was successful?

I am on a pricematch deal if that makes any difference, and I sent the online O2 bill I received dated 28th December 2007 with the cashback voucher stapled to it.
