But: If the timeframe has not passed in which they have promised to send you the cheque by (in their T+C's) then there is no point sending the LBA and sue untill they have broke their T+C's. Cos you wont be able to sue for the whole years cashback until they have commited a fundamental breach in their T+C's and this wont have occured until ???30 days after "receipt" of your cashback claim?

Is that 30 days after they say they have not received it?

Yeah but if they deny receiving it then why wait 30 days?

I think this is because they might find it in within this time, where as if you wait you will either save stamps of have them for fundamental breach of contract.

sent in my 3rd claim ( out of 4)6 wks ago- rec'd text ... but no cheque

called 0871 522 3403 ( I know 10p pm!!! ) got thro' quickly and they confirmed rec'd ( at wrong address- NO! I sent it to where it says on claim form - same as last 2 )

will raise a chq - take another 4 wks !!!

I will have my last claim to send in next week....

must have had 12 c/b deals in my househoold over last 5 yr with them BUT won't bother with E2save / cpw again as the claiming is getting more of a pain, and the deals don't seem nearly as good these days anyway

Beacause you have nothing to sue them for until the 30 days is passed, you will be wasting your money. you cant sue someone because you 'expect' them to not pay you.
