Reading through this post makes me think that I've ben really lucky, sent my first "6 months" claim in a fortnight ago and had my cheque today.
Think I will email them thanking them (keeping them sweet for the next claims...)0 -
I suspect they're more likely to keep "sweet" if they know you'll sue them if needbe, rather than thank them for something you're fully entitled to. Still, perhaps it would be nice; I don't sppose they get much in the way of "thanks" nowadays...0

My situation for what it is worth
-sent for my first cheque but unfortunately I sent a bill that was too old.
-spoke to an agent on how to resolve and it turns out the dates on the internet for my claim window differ from what is on their system. This means I am also now beyond the date to claim but the agent agrees that they will honour the original dates for this claim and so she suggests I send the bill in on next day delivery as i have one day left to claim.
-I ring 2 days later to check the claim has arrived and am told that it isnt on the system yet as i didnt send it to the Loughborough address (as this address isnt the one on my cashback claim voucher). Agent tells me that isnt a problem because they allow time for it to get redirected
-this second attempt is rejected
-speak to a third agent who tells me that the reason the claim was rejected was because it was out of date. I go through the conversation i had with the first agent. She then tells me that I sent it to the wrong address. I go through the conversation I had with the second agent. she then tells me she needs to check the dates on my account area on the internet to confirm the dates are what I say they are. I point out that the first agent didnt ask for this. The third agent insists that she needs to check this and asks for my password. I refuse and insist that they raise the cheque. After a (heated) discussion I get her to agree to raise the cheque.
-Cheque doesnt arrive
-Rang again today and the fourth agent says that to resolve this they will need to get back the recording of the call with the third agent to see if what she said agrees with my version of events.
I have posted before regarding E2Save saying it was easy to claim (i had no problems at all last year for both me and my partners claims). If i remember correctly Mobilejunkie did point out at the time that things had changed and was quite angry with me (I think) for making things sound simple and actaully giving out wrong info (in my defence I was only going by the previous year). But Mobilejunkie - i believe you now and to be honest I won't be dealing with E2save again after this contract. I accept that some people take on these offers without understanding what they are getting themselves into - I dont believe I am one of these people. I have done as requested and am still not getting paid. Also to add insult to injury i missed the next cashback window - my fault i know but you think they would be satisfied that they have clawed back something from me and just give me the other cheque without going through this charade.

lol Quentin - I agree it is a game and I thought I could hack it but experience shows I was wrong.
In my defence though - I was fine whilst life was ticking over - but now with a broken relationship that has resulted in me working full-time whilst bringing up 2 small children, and a history of depression that is rearing its head agian due to aforementioned situation - the game is no longer funny. It is these small things (and I have a list of small things) that are threatening to push me over the edge. Hence the reason for my own sanity I am going to duck out asap and leave those more suited to the game to battle on. Otherwise the money I save on my phone contract will just be spent on prescription fees!0 -
My apologies if any of this has already been covered, I have read alot of this and other threads but not all due to usually reading late and eyes and or brain giving in.
I took out an 18 month contract with orange through OSPS being quite prepared to be organised enough to claim the cashback. I guess like others I was naive in that I didn't realise they would try not to pay even when I did everything correctly, which is of course what they did on my 2nd claim. After two more failed attempts, one re-submitting the other in frustration, I looked to this forum and thought I had a good case for breach of contract, considering they had sent back my invoice with the date they received it which was bang in the middle of my claim period saying it was too late.
So sent LBA and received apology letter and eventually a cheque for that month but like Mobilejunkie said why be happy with what they should have sent you months ago, so proceeded with MCOL claim for the rest of the cashbacks.
I have a few questions. The first is that I think I have sued the wrong people as have just received thier defence and I put OSPS (CPWH group Plc) and I think it should have been OSPS (CPWH ltd) from what they are saying. Can I alter the claim at this stage or do I have to start a new claim and if so could I be liable for any legal cost for the wrong one?
In part of their defence they said that the particulars of the claim are "embarassing for lack of particularity...and are in breach of the CPR16 Practice direction" pararaphs 7.3(1&2) in particular. This seems to be about submitting all or part of my contract/agreement but on the MCOL form there was limited space could I have attached documents?
On the contract theme, I have noticed after reading some of the more recent posts on this thread that I may not have a copy of my original contract/t&c that actually mentions cashback. I have original sent documents but at the time of taking out the contract didn't think to hunt for other stuff. My question is if I am suing for breach of contract what do I actually have to show should I get to court?
