It's up to you of course. But bear in mind there is nothing to stop them "stopping" the cheques at any time before they have cleared.
And it will not make any difference to your case that you received a payment but didn't bank it. If/when you win the case, then you ask the court for the balance remaining from the original claim. (Though in all cases discussed here they have paid up before a hearing).
You should keep a copy of the cheque before banking it to show the date it was drawn, should they try and claim they sent it to you on receipt of your LBA (ie before the claim was issued).
There is no reason why you couldn't write a reply to the email along the lines of "I am only able to accept £xxx (the balance outstanding from your claim after deducting the money now received) from you to settle the case"0 -
I believe you are also required to inform the court if part payment is received whilst the claim is outstanding, so that the court is kept up to date with the amount remaining.0

You don't need to inform the court as part payments are received. The claimant gets put to plenty of inconvenience by the defendant's behaviour without having to report part payments to the court.
Only after the case has got to a judgement is it necessary to sort out the balance still owing with the court (so that the judgement orders the defendant to pay the correct final sum to the claimant - the balance remaining from the claim after deducting part payments, plus interest accrued since the claim was issued and the claimants costs for the hearing plus expenses for the day in court).
If there is no defence submitted, then when you request judgement there is provision to tell the court how much has been received by way of part payment. The judgement will then be for the balance remaining from the original claim plus interest accrued.
You should then inform the court after the defendant pays the amount ordered.
All the cpw group cases that have been reported here have been settled out of court, and it is not necessary to inform the court of payments received in out of court settlements. Once the claim is settled out of court, then it just dies.
As part of their settlement, cpw ask you to sign a proforma letter addressed to the court stating you have been paid, and the matter is closed. Don't return this to them until you are sure the cheque has cleared.0 -
I have had a contract with e2save for 17 months and every cashback payment had been paid ontime with no hassle, even though i sent none of them recorded delivery. On the strength of this I took out another 18 month ocntract. And guess what ? The very last payment on the old conract has not arrived. Having just read all your comments I am now dreading the next 18 months. Does everyone use recorded delivery? It does not guarentee payment it seems and it eats into your cashback deal.0

If your ts + cs insist you send originals, then recorded is a waste of money. If r.m. lose it you've had it!
You need special delivery with consequential loss insurance added.
If copies are accepted, then use recorded. (Even when they sign for them they are known to deny receiving claims - but if you have r.m. proof of delivery then that one doesn't stand up)0 -
Does anyone know the email address for E2save, i want to send my LBA for my first auto chequeback by royal mail and email.
Also, my first manual claim is due, but I have 2 different addresses to send claims to, which one should I use. I have one in crewe that was e mailed to me and one in loughborough, via royal mail, the were both sent to me when i first took out my contract out.

The loughborough post code is intentionally incorrect. The correct post code is LE11 5XH (from memory). My previous claim, sent to "e2save cashback claims, PO Box 8840, Loughborough, LE11 9EL", has however, been delivered, albeit a day late.
I imagine Royal Mail do a postcode search for "E2 SAVE" to find the correct address. Not quite convinced a "One Stop Phone Shop, PO Box 8840...." claim would get delivered correctly though.0 -

No point emailing it. Just post it.
You need to send your cashback to the address in the Terms and Conditions relevant to your contract. When you purchased the phone, you would have been presented with them during the purchase, and hopefully you printed them out.
They have a habit of posting you material with a different address on. And then putting a third address on your account, when you sign in online.
It will also say the address on the cashback vouchers. But make sure you've got the right set of vouchers.0 -
So e2save appear to have completely failed to acknowledge or defend my claim, and MCOL now says "Your judgment request has been accepted. The order has been sent to the Defendant."
How bizarre.0
