On a more pleasant note...my 4th Cash back cheque was waiting when i arrived back from holiday yesterday....only 1 more to go.....hopefully my new contract wont be showing on the bill and it will finish smoothly.....
Special Delivery with Consequential loss has made it a little less lucrative...but Ive now swapped to a sim only deal of 800 minutes, 1000 texts and free internet for £10 a month for 24 months.............and no stress0 -

I have just noticed on re-reading your post that they want you to claim the rest later. Others have successfully pressed on and received the full amount. That's what I intend to do. I was merely being cheeky in asking how polite I should be.
As re their request for an immediate response, I agree that this made me laugh when I read it.
I presume if I bank their cheques for the auto that this may null my claim. As such should I put them somewhere safe an dnot bank them just in case pending their full settlement cheque.Mark Hughes' blue and white army0 -
Getting part payment of a claim is covered many times in the threads.
If they have just sent you the cheques late (ie not in response to you accepting an out of court settlement), then this doesn't affect your MCOL. Photocopy them, keep the envelope they came in and bank them and just let your MCOL proceed.
If however they have sent them "in full settlement" of your claim (or something similar), then return them saying you did not agree to settle the claim, and just let the MCOL proceed.0 -

Sent LBA which they ignored, subsequently raised MCOL which they initially indicated they would defend - they maxed out on their time to prepare a defence to 28 days then informed the court that they no longer wished to defend having settled the claim in full. Cheque received for £235 (£210 cashback plus £25 MCOL fee). Pleased that I don't have to submit & chase x5 future claims but certainly won't be putting any more business their way in the future once this and other contracts have expired. I've taken a Virgin mobile monthly SIM only deal at £10/month for 300 mins + 300 txts recently so it isn't worth the grief in my opinion. Good luck to all in the recovery of what's rightfully yours - you'll probably need to go all the way but should get there in the end.0 -

The cheques don't say anything on them and I presume that they were issued in response to the LBA and my chasing on them. However I will not be banking them just in case (in any case there is no date on them and so I will keep them handy until the matter has been resolved.

When I meant no date, I meant there was no information saying I had x months to bank the cheque or it would no longer be valid.
I assume as it a cheque from a business that the cheques can generally be banked without problems for 6 months if there are no restrictions on them although I know legally they are valid for 6 years.
I presume and hope that the whole claim process with e2save will be sorted out within this timescale and this is why I was refraining from banking the cheque. Whilst I understand this payment represents the auto chequeback that i am owed I just want to ensure that due to no fault of my own the weasels at e2save can't back out of paying the full claim up front.
The reason for asking for advice is partly based on the length of the thread- over 1800+ posts which means it takes so long to go through finding the information. As you have provided so much useful information I thought I would ask you out direct!Mark Hughes' blue and white army0
