  • after reading this thread i feel i need to post but under a different name for obvious reasons....

    i too did exactly the same, i drank and drove and crashed into a wall. i cannot comment on the finance side of things only on the insurance/ban and 3rd party issues.

    Firstly in the majority of insurance policies it has a clause that if an incident is a result of drink or drugs then the insurance is null and void. I was told by my insurance (diamond) that they would not pay out 3rd party costs of the wall. They did not cancel my policy as it was fully paid up and due to be renewed the next week anyway. However months down the line they have paid out and now i am paying back £1160...expensive wall yes i know (that also includes the cost of 2 wrought iron panels which 3rd party claims were replaced but which werent which is technically fraudulant claim on their part however my insurance dont give a toss and paid out anyway) this is what the other posters mean by reclaiming their losses.

    Secondly how much over the limit was he? i was twice over the limit and was told with my co-operation i would get 18 months ban-2 years at least. I was given 18 months reduced to 14 after attending the drink drivers awareness course (£155)

    I have just recently got my licence back (£60) and have found that some insurance companies will still insure you for reasonable rates depending on the car you choose to drive.

    I actually sold my car on ebay after my boyfriend put in the listing "here is my girlfriends car, she didnt like it so decided to park it in a wall"

    like i said i cannot comment on the finance side, i hope he gets things sorted
  • Many thanks for you advice. The legal limit is 35 and he was 80 i believe.

    It's a costly mistake, but hopefully a little bit of a wake up call. If it was just the car that he had to pay off i think i would tell him to shut up and pay it. But with so much money on it, it will double his debt and i hopefully am using this to pull his head out of the sand about his debt in generl.

    I must admit i assumed his insurance would be void straight away, but clearly that isn't how it works.

  • i wouldnt say well respected but a few people know me but not my circumstances, my limit was 72. he really does need to sort his insurance out. can i ask who's wall wa it he hit? a householders or one on the main road as i've known councils to bill the people who knock them down. I've even known the highways agency to bill a car driver when he had a blow out and hit the central reservation!

    I'm sorry, but why are you sorting this out for him? His mess, his problem.

    He may have been stupid enough to drink and drive, but surely he's not so stupid he can't make a few insurance calls

    In your situation, I know who would be sorting things out, and it sure woundn't be me

    I spoke to the insurance people and they said there get out clause would be that he:

    'didn't take reasonable procautions to keep his car safe'

    so, i think by the sounds of it just going to have to cross the fingers lol......

    As others have said complain and then take it to the FSO.

    They can’t have a clause like that, way too vague. If being drunk counts as 'didn't take reasonable precautions to keep his car safe' and lets them get out of paying then what about speeding? Driving too close to the car in front? Scraping a gate post?

    I’d have thought that most (all?) claims involve some form of not taking reasonable precautions

    The reason i'm sorting it out is because i generally do, and thats not just for him thats for everyone lol Bills, refunds etc you name it. Anything that needs a bit of work normally gets thrown my way.

    He is going to sort it out just lacks some skills. I can call a company and get what i want from them but other's struggle. Most of the people i know aren't confident ringing up somewhere and getting done what needs to be. Don't know why, i have a bigger mouth so maybe i just do it better lol

    He will be sorting his own mess don't worry. Like i said before he has other debts and i've been speaking with him and were going to make a plan and stick to it. I'lll take over to start and then gradually let him take over payments etc (planning on having his online banking, setting up bill payments etc etc) so that way instead of chuckin him in, he'll slowly learn how to manage his money better.

    I'm generally the fix it girl, normally cos i like a good argument and somehow manage to get my way :beer:

    Judging by naughtgirl78's past experience its likely to say that he will be expecting a hefty bill from the third party's wall. Stone walls are more expensive to rebuild/repair than brick ones

    Yes, it's a good wage. I would personally love it, but i'm quite sure other people recieve the same or more and still manager to make a muck up of things.

    It is a nice wall, and pretty much as stuffed as the car, although i must say i have seen the wall down a few time. It's on a sharp corner that catche's a few people out. Just after this corner there is again another sharp corner where the houses are lower level and right next to the road, seen those two houses quite badley damaged. They have actually errected speed bumps after god knows how many years as people fly round the corner not judging well enough.
