i'm not saying he can't pay it off. He has some more debt, been a bit stupid with his money, but even on 350 a week 15k is still gonna take time to pay. Just looking at way's it may be possible to reduce the amount.
The insurance company say's it looks at claims on an individual basis so were going to submit a claim to be processed.I get what i want. That isn't because i'm a brat or spoilt. It's because i'm determined, i work hard for it and i achieve my goals!0 -

The broker is KGM Motor Insurance provided by Premium Choice
If I've checked the right policy document on KGM's website the only exclusion for driving under the influence refers to the personal accident £2k payout - is this what you found? I had no idea that insurance would still be valid but if folks on here have known insurers to payout it's got to be worth challenging the insurer.

I spoke to the insurance people and they said there get out clause would be that he:
'didn't take reasonable procautions to keep his car safe'
so, i think by the sounds of it just going to have to cross the fingers lol
He's not a bad egg, plus he only racked this debt up since i dumped him lol feel a little bit responsible ha ha :rotfl:I get what i want. That isn't because i'm a brat or spoilt. It's because i'm determined, i work hard for it and i achieve my goals!0 -

I don't think using that clause would stand up to the scrutiny of the Ombudsman.
You need to send the Insurers a letter by recorded delivery requesting them to give you a written decision on the claim. Mention in the letter that should you not receive a satisfactory response eg they agree to the claim then you will be making a formal complaint and if this does not result in the claim being paid you will then take the case to the Ombudsman.
I'm not sure how the Ombudsman will view it but I suspect he will require them to pay the whole claim. This is on the basis that he does not like vague catch all exclusions like this. In addition the fact that some Insurers specifically mention they will not pay for own damage claims if there is a drink / drug driving conviction as a result of the accident will also influence his decision.
A well worded letter could result in the policy being reinstated and all of your claim being paid (The gap policy might have a drink driving exclusion though as some do).
P.S Mention in the letter you expect the policy to be reinstated as you feel the cancellation of the policy is also unfair.0 -

Yep, if he does something at least he does it well.
I'm going to make the claim call tomorrow. In the GAP it does clearly state they will not pay out for drink driving, very clear cut.
I will start the process and see what they say. If they do decide not to pay i shall take the advice and threaten them with the onbudsman as i do feel it's not very clear. Obviously you don't check your policy to make sure you can drink drive and get things paid, but looking at it i don't understand how they make a decision.
If they go on a case by case review how on earth do they decide what to pay and what not to. Knowing the criteria would be interesting, as my ex said, if they don't have to pay they prob won't (like all companies, if they don't have to, they won't, and if they do have to, they still try and worm there way out lol)
I shall have to get the ball rolling and see where it goes. Worth a try even if there's only a slim chance. I will still have a good few grand to pay with the GAP being void.I get what i want.
