Which Insurer is it and we can check their policy to see if they are obliged to pay the claim or can deny the own damage part of it?

I know of 2 people who wrote off cars while drunk and in both cases the insurance paid out.

They are legally obliged to settle third party claims, but do not usually cover the comprehensive part of the policy. They may try to recover third party costs from the policy holder.

This is only correct if their policy specifically says they will not pay the own damage part of the claim. The majority of Insurers do not exclude cover for your own damage if you are convicted of drink / drug driving. It tends to be the cheap and cheerful companies that include this restriction or some include it if you have a previous drink or drug driving conviction
  • Just looking over the paperwork now. It doesn't state anyway that drink driving is an exclusion.

The broker is KGM Motor Insurance provided by Premium Choice
