Bank Charges Reclaiming Guide discussion

I have not started reclaiming yet but from reading the reclaiming guide it turns out me and my partner fall under the hardship category. CAB are currently dealing with our situation as we are in £18000 worth of dept on top of a mortgage and struggeling to pay priority bills. I have just started paying creditors we owe money to and have realised that if I claimed back bank charges that over a £1000 pounds or more of the debt could be paid off if we were awarded the bank charges back. Am I still able to reclaim bank charges from banks and credit cards if i owe them money or are they likely to cancel the new arranged payments I have just set up through CAB and demand all the money owe to them back. I am worried that reclaiming bank charges from banks I owe money to will go against our case with CAB. Does anyone know what i can do or been in the same situation that can help? I feel that the bank charges has played a part in the debt we have got ourself into.0

I went to the FOS when Lloyds managed to lose my bank charge complaint letters and didn't process my complaint within the 8 weeks allowed.
I had sent them to my own branch and received a response to them from my own bank manager but the complaints team said they never received them.
Now after having the complaint on hold with the FOS I received a letter saying that as the charges weren't seen to unfair they were rejecting my claim.
I then wrote and said that Lloyds didn't treat me fairly as they didn't process my complaint at all, no 4 and 8 week letters
I have now received a response from the FOS stating that I only went to them because Lloyds had rejected my charge complaint which wasn't the case at all.
I'm now in the process of making a complaint against the case assessor at the FOS because she has come to the result based on info she thought was there not was actually written in the letters.
Does anyone know what the next step would be if they still reject my complaint?0 -

Hi Forum ...some advice needed. I have an ongoing complaint re charges with RBS on which I have amended my complaint inline with the new arguments. Yesterday I received a letter through the post which is very long winded and attempts to bamboozle me with legal jargon. I expect its just a standard letter from RBS but any feedback?advice would be most welcome. Needless to say they are still saying the Supreme Court ruled that fairness does not apply to the Consumer Credit Act etc etc

is it possible to claim back to this date, as most of my charges were from then, which basically was caused because halifax changed my account to a cash card which didnt have an overdraft facility so thay with drew my £250.00 od without actually telling me. I have had some charges back but they said they could only go back 6 years and i didnt ask for interest.0

If that results in no joy, are you prepared to take the matter to court? If so, expect a lot more legal bamboozlement and read Martin's advice on the risks involved in taking court action over the matter; there's no guarantee you'll convince a judge you are in the right and even if you do, expect the bank to appeal to a higher court (until they win or get to the Supreme Court where they won last time)."Now to trolling as a concept. .... Do I need to write to my local branch of barclays to ask them for the charges back or to their main branch??0
